Student Loans in Chapter 7 Bankruptcy
After much thought I have decided to file for ch 7 in NY. I have to file without a lawyer, because I don't have the money to do so.
The reason I decided to file after some time was that my credit card company was seeking legal action against me. I have a no-asset case, but still have some questions. For instance, I listed all of my current creditors on my schedule F, including my student loans, after doing my own research I found that student loans are not dischargeable but I have several private loans that I used for education purposes. Are the private loans dischargeable?
Any help would be greatly appreciated.
Re: Just filing for ch 7 on my own
Maybe. Are they federally guaranteed? Who are the lenders?
Re: Just filing for ch 7 on my own
I think it unwise to do this yourself. Many many years ago I found myself in need of BK to save my family. I did retain an Attorney but had littel money. What we did was make payments to Attorney when we had paid him in full we went through with BK in meantime he acted as my Attorney and I was saved all teh calls from creditors! Unless you have some kind of legal background you could forget or miss important matters that could cost you later. I suggest you find an Attorney to at least discuss this with before taking matters into your own hands
