    Assault With a Weapon and Willful Infliction of Bodily Injury
    My question involves criminal law for the state of: CA, Los Angeles County, Lancaster area

    33 yr old mother finds out ex boyfriend had killed 1 of his girlfriends, raped a family member, and molested 2 children in diary entries she was forbidden to touch.

    Ex boyfriend is asked to leave peacefully by her and that relationship is over, and ex boyfriend beats her up chokes her to where she can't breathe and tries to destroy c section on girlfriend then tries to stab her with a knife for breaking up with him and for touching journals and and he says he'd rather kill her than let her break up with him.

    She flees scene ex boyfriend calls 911 after she gets away and ex boyfriend states she is trying to kill everyone come quick.

    She severely injured cut up beaten, bleeding, choked, barely able to walk, ex boyfriend only scratch.

    She gets arrested. Now facing jail and is innocent.

    Plea is not guilty, on last day for pre trial

    Lawyer is saying theres diversion program; my research says violent crimes don't qualify for that which means lawyer is lying to her.

    Lawyer also states since ex boyfriend is in hiding due to fear of his crimes, and won't appear that case will be dismissed.

    Research says they'll use 911 call to prosecute her.

    Innocent mother false arrest facing trial soon.

    What can be done to clear this when its been clearly presented in court that she is innocent DA not dismissing and shes facing potentially year in jail false arrest.

    Were you a witness to any of this? If not, what or who is your source of information?

    What are her specific charges? (Code sections, preferably ...)

    Clearly, there is a lot more to this tale.

    Police told witness to sit on couch that witness had no say
    Even tho witness was also injured by ex boyfriend
    Police only took ex boyfriends statement
    Ex boyfriend wrote confession he lied to police and is mentally ill and was previously in mental hospital was turned in to DA no response for dismissal

    Then clearly there is more to this ...

    PC 245 (and there are a number of subsections for weapons or force, so the actual offense varies) and PC 273.5 can both be felonies. Yes, there can be diversion for PC 273.5 ... depending on the PC 245 a deal might be possible.

    She should probably listen to her attorney, or, if she doesn't trust him, get another one. Non eof us has the foggiest idea what the DA knows or what the police know, so we are not in any position to remotely second guess anyone here.

    Also why would police seeing how badly injured she was from this guy, the guy only a scratch 1/2 inch and hairs width and fine,
    why would they arrest her when he beat her up terribly, and silence an additional witness who was also injured by him?

    It's definitely not protocol at all for procedure on PO's end.

    You're saying that this man tried a DIY c-section?

    Are you sure you're using the correct terms?

    There is a lot missing from the story. And, if you weren't there, then I suggest you are not getting the entire story.

    She needs to listen only to her legal counsel as he or she has the reports and the necessary details.
