    Employee Received Great Evaluations But Has Not Been Promoted
    My question involves employment and labor law for the state of: Arkansas
    I have worked for a local Hospital since 2011, during my employment here I have moved up from Admissions to Financial Counselor. I am an excellent collector and trainer so good so, a FC I trained was granted promotion 2 years in a row now making her an FC III. My department has this thing called a career ladder, you create a personal folder of all yur acheivements throughout the year and submit it at time of EVAl, I was totally prepared with letters and awards in my folder for my 2013 eval and was told they would put it in my file that I had to wait one more year to move up. I had a great eval and received 2% increase. During my 2014 Eval I did so well I received 3% and asked my supervisor then for my promotion to FC II, she asked for my career ladder. I explained it was in my file, she looked. IT WAS GONE! (did a mention the 2013 supervisor had been fired?) I was told by my current supervsor she would look for it and let me know. Months 7 to be exact went by, another employee I work with was promoted to FC II this month she was not required to provide a career ladder. On top of that she was raised 10%, she informed and advised I should ask again. So I did, well now it's to late and I have to wait until 2015? My question is....Is my employer required to make this right as soon as it was caught? and should I be awarded backpay? I am the only FC in this hospital that is cross trained and has taken on call, being top collector months in a row. I didn't know the I, II, III status came with so much of a raise, now I feel like they have messed with my income and put me behind those I have trained? What can I do? Please help

    You do not have a right under the law to a promotion, so no, your employer not only is not required to 'make it right' immediately, they are not required to make it up at all. No, the law does not require that you receive backpay - the law does not even require that you receive a pay increase.

    This is entirely up to your employer. Barring a legally binding and enforceable contract or CBA that expressly states when you will receive promotions and pay increases, the law does not care whether you ever get them.
