    Can I Shut Off Water in My Rental House
    My question involves landlord-tenant law in the State of: california

    hi im a new landlord and i have a tenant thats not paying. the utilities are in his name EXCEPT the water. the lease says "tenant will pay directly for all utilities, services, and charges provided to the property, including any and all deposits required." i was doing him a favor keeping the water in my name so he wouldnt have to pay the deposit but now that hes delinquent with rent, etc.. i dont feel comfortable having it in my name anymore. i gave him a 3 day notice to pay rent or leave. i also want to get the water off my name immediately. hes more than welcome to transfer it to his name, i just dont want to be liable anymore. is it ok to do that? thanks alot. by the way im new to the forum too. thanks!:D

    btw i think "shutting off" is not the right term, i mean to transfer service to him. thanks

    Absolutely not.

    In fact, doing so is going to land you in very hot water (no pun intended).

    Your remedy is to try and recoup what has been charged to your account, not to shut it off.

    Have you considered taking a Landlord 101 workshop? You'll probably find something local if you look.

    ok thanks for the reply. i thought it would be ok since i just want it transferred to his name. im not doing it to evict him and the lease says he must pay directly for utilities but i guess its a tricky subject. thanks for the info

    The problem is that it's already on in your name - I'm just not convinced you can switch it over to him without him doing so himself.

    Have you asked the water company what their procedure is?

    i think youre right he does need to switch it himself giving a deposit, i can only switch it off.
