Laid Off Employee Denied Unemployment After Employer Said He Quit
My question involves unemployment benefits for the state of: Pennsylvania
A couple years ago maybe 2 or 3, my dad was working for a company which had to lay him off from low business. It was a couple months ago the employer had filed that he had quitted instead of been laid off and that lead to the unemployment benefits being requested to be repaided. The unemployment benefits were accepted years ago and my dad had been collecting for some time. My dad had gone to court against the employer's claims and lost probably as a result of his poor communication skills since he is an immigration and speaks only a fair amount of english or from lack of evidence of bring laid off. The appeal period has passed and it's been a few months since the case was lost.
They simply took most of the money from my parents joint tax return. Is there any other way to fight this?
Re: Worker Claims Quitted Instead of Laid Off. Lost case and appeal period is over.
I'm sorry, but no. The appeal period has passed, and it's a done deal.

The answer I was expecting, but not hoping for. Thanks anyways.

Please check back again in the morning though - the East Coast folk are sleeping, and we have some experts there who have far, far more knowledge and experience than I!
Don't hold your breath, but still check back, k?

Something does not sound right here. Are you absolutely positive (as in, having proof) that this was due to the employer suddenly contesting a two year old claim, or are you assuming that is the case because you can't think of any other reason why the UI office would deny benefits?
