Being Sued by a Junk Debt Buyer
My question involves collection proceedings in the State of: Oklahoma Hello All, My question is in reference to being sued due to credit card and medical debt, A junk debt collector company has picked it up, so if I am summoned to appear and ignore what can I expect ? Thanks.

    what you can expect?

a default judgment and somebody taking every legal action to collect on that judgment.

You can expect them to be awarded a default judgment in any amount they say and they won't have to prove a thing.

Then they will garnish your wages, attach your bank accounts, record the lien so it becomes a lien on your home that you own now or will own in the future. They can also come after non-exempt personal property which could include your car.

    Oh, and trashed credit, too.

The judge will ask you if you have anything to say, but since you don't pretty much the same if you hadn't been there. They'll likely give you the paperwork for the further collection steps to your face rather than mailing them to you.

You would be well advised to contact the collection company and work out a deal and payment schedule before you go to court.

Work HARDER with them to resolve it and then have them withdraw or kill the case ASAP. One thing you do not want is a public record on your credit report. It will stay for 10 years minimum but can be renewed in most cases. Get any settlement agreements in writing and fully executed.

it is very unlikely they will withdraw the suit if they have already filed it. More likely they will agree to a stipulated judgment in an agreed upon amount.
