How Can a F1 Student Get an Employment Visa
Hello All,
I am an international student and I am on F1 visa. I just finished the first semester. I am offered a full time time job recently. I know I can not work legally in the first academic year out off campus while I am on F1 visa. Also, I know the H1B visa deadline was finished. What is your idea? How they can employ me legally? Can I ask them to request green card for me? Totally, I want to know is there any legal way for that company to employ me?
Re: How Can a F1 Student Get an Employment Visa
The company will need to have legal counsel on how to go about qualifying for H1B applicants such as yourself. It's a specialized area of practice.
H1B is not about you, it's about having a qualifying job that can't be met with legal US workers and that is not otherwise restricted.
You may qualify for a limited period of post-completion OPT on your F1 visa. You should talk to a lawyer or perhaps your schools international students office.
Re: How Can a F1 Student Get an Employment Visa
Are you an undergraduate or graduate student? Unless you have the equivalent of a US bachelors degree, you are not qualified for an H1B visa. A green card requires that they be unable to hire a US citizen or current permanent resident for the position; this is a high hurdle since you are only a student. Depending on your country of birth, the time to a green card is very long.
No company just offers a student a job. You should not have been seeking employment. Off campus work authorization is very limited. Your international office should have advised you of this during orientation. Your friends might be telling you that you can get CPT. This is only available as part of an established curriculum.
There is not likely to be a way to work for them legally. Do NOT work illegally as this will kill your career in the US as illegal work is a very serious offense.

Thanks for your answers.
I am from Iran and I have seven years job experience completely related to my studies and the job they need. I just want to know whether there is any legal way for them to employ me or not? I asked the International Center of my university. But, they do not know. One of my friend who has been in the USA sunce 5 years ago told me the only way is they request green card directly for you and because you have special experience for a long time, they will possibly be successful to get it for you.
Anyway, I welcome your recommendations.
Thanks.

so far nothing you have said suggests there is a legal means to employ you.

I cant understand what you mean? Do you mean there is no legal way?

Another company invited me for interview. Now, I am at Chicago and they are at Houston. I want to be sure before going for interview. I told both companies about my visa problem.

you have given no information that would allow one to speculate such that there would be a legal means of having a result of you being employed and it be legal.
whether there is a means to employ you legally cannot be ruled out completely as nobody here has access to all the information necessary to make that determination.

sounds like you are actively seeking employment. If not, how would some company in Chicago even be aware of you?
stop doing that.

So you are actively violating the terms of your visa. Expect to be reported and deported.
Re: How Can a F1 Student Get an Employment Visa
I explained my background in my previous posts. I am a graduate student and have seven years job experience. My background is in line with the jobs and duties many companies need. I am in the first year of my studies and I know I can't work officially on F1 visa during the first year. I am not looking for a job to work on F1 visa. I am looking for a way to change my visa( to any other visa or green card).
I also find many jobs at Chicago and Illinois. I had an interview last week at Chicago and I told them about my visa problem and now I am waiting for their response. I am sure looking for job is not something illegal. Employment is different from looking for job.
Many companies contacted me, but most of them told me they can't sponsor me. I do not know it costs them too much to sponsor me or there is no legal way to do this. Even I can't find a job(because of any reason), I can get in touch with different employers and I am sure they will sponsor me for H1B visa for next year. It is a good experience for me.
So my main question is:
Is there any legal way to employ an international student legally and officially while the student has F1 visa and he/she is in the first academic year of his/her education?
Please let me know, if you need more information. I am looking for an exact and clear answer.
