    My question involves criminal law for the state of: Texas

    Earlier this year I had planned to grow a small amount of marijuana for personal use. I ordered 2 seeds from a country where they are legal to possess and sell, and had them shipped here. They were delivered, but the package was taken from the mailbox by someone I live with, opened without my permission and destroyed(I confirmed this). Its contents only, not my name or address were photographed once but I don't think the person still has the picture. I never saw the package or had anything in my possession.

    Is the act of ordering the seeds, or just possession of them illegal? I know they become illegal as soon as they crossed into the US, but if they were never in my posession could I still be charged? I am considering reporting the person for stealing and opening my mail. I have nothing drug-related or illegal in my home anymore and can pass a drug test. The only evidence an investigation would yield is the possible picture, and maybe the testimony of the mail thief, and I'm thinking it would be difficult to prove I even placed the order in the first place.
    What, if anything, could I be convicted of in this situation?

    You really are kidding, right?

    you go right on down to the cop shop and tell them somebody stole you marijuana seeds. They will be more than glad to help you out.

    I was going to report it to the USPIS, local PDs don't handle mail theft. Stealing and opening mail regardless of what's inside is a felony. Am I really that wrong for weighing my options in this situation?

    If I go to the authorities, why would I possibly tell them I ordered marijuana seeds? The whole point of this post was to find out what charges could be brought against me given that there is no hard evidence of what was ordered. Jesus, it was a serious question.
    The company ships a few gift shop items with every order that cost me more than the seeds. That stuff was stolen as well and would be reported as the contents of the package if they wanted that information.

    No not high, like I said in my question can pass a drug test but thanks for reading I guess.

    You think the police are going to investigate a report that somebody stole the contents of an empty box? Believe it or not, they're going to want to know what was inside.

    The company ships a few gift-shop type items with every order that ended up costing more than the seeds. That stuff was also stolen, destroyed and would be reported as the contents of the package.

    when they question your roomate and your roomate turns you in you saying he was destroying the package because he knew you were ordering illegal drugs over the internet and didn't want to get caught up in it.

    He didn't know the contents of the package prior to opening. He knows I have used weed occasionally in the past and is fine with it as long as I don't do it at our house, which I agree to. We never said anything about mail though. He happened to be home when it was delivered, saw it was international and opened it on impulse which in my opinion and by legal definition was an invasion of privacy. I have a written confession that he stole, opened and destroyed the package, and that is a convictable felony regardless of what is inside. If I report him he would definitely get an investigation launched against me, but I don't think one person's testimony would be proof beyond doubt of what was ordered.

    That is the plan. I was definitely interested in what you all had to say or I wouldn't have signed up here. I get that this is an informal place and information on the internet is worth what you pay for it etc but it appears you can't ask a serious question without being ridiculed. great legal forum you have here, surprised all the legal enthusiasts are such big fans of vigilante justice. :wallbang:

    You are too stoned to ask a serious question. I suggest sobering up before spending money on a lawyer.
