He threatened to go to the police if we didn't immediately agree to pay him nearly $7,000, an amount in excess of what he had even paid me for the website. He sent rude, threatening texts, and told my husband that I was the office cocktease. Obviously, he couldn't be reasoned with, and we offered to refund him if he would give us a breakdown in writing of what we were refunding him to protect both me and him. This enraged him and he filed a police report. My husband and I were questioned by an investigator about three months ago, and after that, I chose to retain legal counsel.
At this point, the claimant is suing me for treble damages in restitution, and pressuring law enforcement to prosecute me. His attorney sent my attorney a letter saying that a warrant had been issued, but not served. My attorney checked with the clerk, and determined this was not accurate.
I feel like I am waiting for the other shoe to drop, so to speak. Obviously, I need to be preparing myself for a long, expensive battle. Any of you guys have some pointers to help me protect myself, build my case, and avoid prosecution, relegating this to a civil matter only?

there is little you can do to avoid prosecution. Either the prosecutor finds adequate support for charges and files them or they don't.
and prepping; whatever your lawyer tells you to do. More than likely that would be to say nothing to anybody and for God's sake, don't post this on the internet with any sort of details.
