    My question involves a marriage in the state of: California

    What is the legal effect of legal separation on IRA spousal rollover in CA? Does it invalidate it? Trying to find some type of authority one way or the other.

    Are you talking about a spouse who died while separated? Are you sure you're talking about the "rollover" itself or are you questioning whether the spouse is still a beneficiary of the retirement account? By legal separation are you talking about one that was issued by the courts? Who, if anyone, was listed as the IRA beneficiary?

    In terms of legal separation, one that has been issued by the courts yes. Husband and wife list each other as the IRA beneficiary. Neither spouse has died yet, and each is still a beneficiary of the other.
