Seventeen-Year-Old Wants to Get Emancipated in Texas
My question involves guardianship in the State of: Texas
I'm 17, and i have a job, and i'm soon to be a manager of this job after only a month and a half of working here, which greatly shows my maturity and responsibility, once i finish my paper work. Living in hud housing i can live on my own very close to work (within walking distance) and im wanting to be emancipated. Or a cheap apartment will do fine.
There's issues going on at home and serious uncomfortably and stress. I'm incredibly unhappy here and i need to get away from it.
I've lived away from my parents before for 6 months while i was away with my brothers working a full time job while going to school, and everyone i know could EASILY tell i was much happier, i was rarely ever angry. At my old job everyone thought i was 23 before i told them how old i was and i worked there for a good month (only quit because the manager didn't like me so he was basically harassing me and calling me out in front of customers if i made a tiny mistake) I basically pay for all my things and my parents don't pay for my medical bills. And i don't buy groceries cause my parents get them and i'm trying to save up, but if i was living on my own i wouldn't mind buying it myself, i know how to ration food. Right now i have a tooth that needs fixed and my dad wont pay it, his excuse is that he needs his fixed when he's 52 and his are ruined from not ever brushing his teeth and he honestly doesn't plan on fixing them, he just wants a newer car.
I payed a phone bill of my own, and bought my own phone, for several months. I'm only on my parents now because my old phone cracked from the ice and if i sent it in for warranty it would have taken 2 weeks and i needed a phone for work.
I've bought the only things i have for entertainment and i've always been very independant, at school i always got compliments from teachers and counselors that i was ambitious and incredibly smart and mature.
I feel like i could get emancipated easily but i'm not fully aware of all the laws and processes for this state because for the last 16 years i lived in georgia.
I want to know what rights i will be getting besides the obvious, and a few hoops i'll have to jump through to get it done.
I honestly want to live on my own, not just to get away from myself, but i feel ready to be an adult. I only have a year to go but that year can change a lot. I normally wouldn't mind waiting but with everything that's been going on i know that i need to get away from here or i will have a mental break down. (i've had a few series of stress issues and panic attacks when i was younger, when i moved out and lived with my brothers they got better, and going to work means getting away from my parents so that also helps)
I just really feel like it's what i need.
I know i can do it, and i know it means cutting off any expectations from them, and it might even make my relationship with them, or my family as a whole towards me, worse, but honestly, i'd rather be happy, and my family doesn't have tight lines anyways, i'm disappointed in how all my siblings have turned out and my parents just aren't suitable to be around anymore.
So bottom line, i need someone to lay out the laws and procedures of emancipation in texas.
I know people are probably going to say "you should just stay with them it'll be too hard" but i'm pretty sure i'm capable, and i've wanted emancipation for years.

The bottom line is that if you cannot show the court that you're able to live completely independently, supporting yourself, emancipation is not an option.
There are no ifs, ands or buts here. It's extremely straightforward.

You can run away at 17 in TX. As long as you provide your own shelter and work, provide the local police and your parents with your where abouts, they cannot drag you home. Bringing a boyfriend or other person into the picture can bring harboring charges or worse.

I know i can leave but i can't sign my own contracts or open my own bank account and my mother tries to control my money and if i use it for something she disagrees with she just yells at me and tells the whole world about it. I also want to back home to Georgia soon, i grew up there and i was ripped away from my roots and i've been having major headaches ever since i moved back in with my parents for six months now, and this heat is ridiculous.
I don't want them having control or access to my money, and without emancipation that's not an option. Not to mention all the other issues going on in this house. And furthermore, if i can't sign a contract to a house, or live with someone else without problems, where am i supposed to go? That's where that law drops. You can run away, but you'll end up coming back because you'll have no where to stay.
I want to live in my own place, i have furniture (no they didn't buy that either, the bed was given to me by a neighbor who had no use for it because they were moving and it was a guest bed, and the dressers were and old friend's. Bar one that used to be my sisters, but i don't like that one anyways.
I know there are no ifs ands or buts, really i don't know what makes you think that i see it that way. All i'm asking for is what procedures i have to go through and what papers i need. I know it's 'straightforward and serious'
I know i have to be independent, and i'm fully capable of doing so. I know how to manage everything financially and i know how to take care of myself.. Other than living under their roof, i'm relying on myself for basically everything.
All my clothes were secondhand from my own choice, my parents don't buy me clothes anymore, they don't buy me anything except food and when she's at the store she might pick up some hygiene items for me because i'm not always with her when she goes the store.
Also, no where does it say i can't have help through low income housing, it simply says i can't ask for help from my parents. There's full grown adults that get help from those sort of things, that's what they're there for, and if there is something against it, i'll get a second job, or simply go back to georgia, like i honestly want to, but i need to get a car first. The place i'm looking at is in walking distance of work so i won't need to drive to get there or the grocery store, and in the mean time i can save up, and then i'm going back. In Ga apartments are the same price for what i'd get on low income housing, otherwise i wouldn't need it but rent is ridiculous where i'm at.
I get it, i'd have to be independent, i KNOW that. All i'm asking is what paperwork i would need and what's the process i have to go through.

No, that's not where the law drops.
That's where the law accepts that around 99.9% of teens don't have the resources, maturity or capacity to live alone. You're no different.
So here's your freebie.
How are you going to do the following?
Pay full market rent
All utilities
Health Insurance
Clothing
Food
Transportation
Sundry items
Emancipation is about need, not wants. Think, "parents died on crash, minor needs ability to sign contracts".
It's no different in Georgia.
So, who is providing your housing and utilities at the moment?

Just because YOU don't seem to understand what INDEPENDENT means, doesn't mean that a JUDGE won't. There is NO court in the country that is going to emancipate you so that you can be supported by TAXPAYERS or programs supported by taxpayer dollars. Emancipation is granted on basis of NEED...not simply to teens who don't have the patience to become adults and who are not FULLY 100% capable of supporting themselves WITHOUT financial aid. It will NOT happen. You need to be prepared to pay the going market rate for rent.

Let's put it straight like this. My fathers a pervert, my parents are alcoholics, they're extremely verbally abusive and they refuse to help me with medical needs before i get an infection in my jaw or the several other medical problems with my "woman organs". My siblings can't help because they're all in their own tight places.
As i said, if going off of low income isn't included, i WILL go back to georgia and get a fully paid apartment, for the SAME price as i would in low income HERE. I can qualify for a fully paid appartment there and still have a bit over a thousand left by the end of the month.
Food is easily rationed, i don't need cake and junk and fast food, in fact those things make me sick to my stomach because i have serious acid reflux which is going untreated because of my parents, i have no way to a doctor.
I have plenty of clothes, i don't need high end fashion and all these crazy accesories, i don't wear jewlery, and i wear maybe 13 dollars worth of makeup that lsts me about 6 months.
I've had the same shoes for a year because i don't care if they're dirty. I have converse because of the type of feet i have and because they are very durable and if they get dirty, it really doesn't matter cause it wipes off.
I don't need high expenses.
Where i would preferably live, all i have to pay for is my phone bill, which will only be 50 a month because i don't like phone contracts, internet, and electric.
I don't watch cable, and i don't need any other bills to pay because they give gas and water free in most appartments there.
I would be making more than 3 times the rent to live in an appartment there for a 1 bedroom.
I'm not getting a gas guzzler for a car and i don't have much social life so i wont be driving it unless it's for work or every couple weeks i go to the grocery store. Unless the clothes are for extremely special occasion and i need to see the fit, i buy everything else online other than food.
It's not hard for me to manage money, i'm actually quite smart with it and i try to get my mom to understand but she wont, she wastes money she doesn't have.
So as far as paying things? i'm pretty sure i have that settled.
Bout 500 in rent maybe, and everything else to bills and necesities and still have around 1-200 to just save or spend.
I'll have a full time generalmanagement job in a week, and i can get a transfer.
I'll get over 1k a month from that job, and i might get a part time one on the side, and there's a possibility of me getting a roommate later down the line.
I am prepared to pay the "going rate"
But guess what? austin is OUTRAGEOUS on rent. We are paying the same price for the smallest single wide trailer than we did for a 3 story house with a basement and attic, with an in-ground pool and a huge yard, in georgia.
I don't /need/ the hud housing, but it is nice if i can get it so that i can be here for a bit longer to get money saved up before i take off from the state to a new job.
There is one appartment in the area that has a reasonable rent, the rest is about 1k for a one bedroom apartment with no appliances or utility payed.

I can walk to work, I'm not lazy, and when i get a car, it's still not that bad.
So i'm sorry to sound incredibly rude right now, but really, so do you.
I KNOW it's not easy. i KNOW it's a challenge. But one year only makes the difference of less stress and pain coming from my parents and less risk.
Introduce me to another "teenage kid" who has been offered management jobs at several jobs, and is getting one in less than two months of working somewhere, instead of all the other m.i.t's they already have trained.
Introduce me to a kid that has a fully level head dealing with finance, business, and expense.
The only way i am immature is i do joke around, everyone does. And i do get angry. But everyone does. But i'm not going to cry and throw a fit because i can't have shoes with diamonds on them. All my clothes were either bought second hand, were gifts, or they were from my elder siblings. I'm a child of 6, and i'm the only one that's trying to get myself together. After all of my older siblings realized how much worse my parents got, they all wished that they could help me, but they can't. So i'm helping myself. It is NOT a want. I don't really want to grow up yet because my last few years have SPED by. I never got to have a teenage life. Ever. I've never partied and hung out at the mall or gone to the movies with friends, i don't have friends in my phone, they're all family members and work. I've been in relationships, but usually i find out the person isn't worth a breath of air. I can't be social with people my age because it's awkward, i don't find humor in what they do, ever since i was in elementary school, teachers and counselors and such were my friends, i'd sit after school and just talk to them all the time, and draw for them. I'm a wonderful student and a great worker. This isn't something to take lightly, and it's really bothering me that all you guys are doing is shooting it down because i'm not ONE YEAR older.
A year is literally nothing as far as maturity goes. I feel no different than i did a year ago, or the year before that. 4 years feels like 1. But a lot does happen, and that's why i know i need to get out as soon as possible before i regret not taking the chance to.
You think i want to live by myself and be lonely outside of work and the one friend i do talk to? No, i don't, but it's better than dealing with what i do. It's way to personal and home related to just spill all over the internet, so i don't expect you to understand.
So please, if anyone is going to reply to this thread anymore, i'm done listening to people bash it down, just tell me what papers i may need, some resources that could help, and what/whom i should contact. That's why i made this thread. Not to get told i'm just a bratty kid with no sense in my brain just because a number is one less.

Another strike against you. "Rationing your food" = you cannot afford to support yourself. If you do this as an adult, yes - it wouldn't be an issue. But you're not, and the law tends to want to protect minors from themselves.

then go back and read what you bookmarked. There is most of the information you need right there. Then contact the court clerk and ask for the proper form to file.
the rest is up to you.
when you say your father is a pervert, depending on what you mean by that, consider contacting child protective services or the police if applicable.
as to your health issues; child protective services
your parents are obligated to provide for you and if you are in need of medical treatment they are not providing, they are lacking.

If you are making that kind of money now why don't you take yourself to the doctor and/or dentist? If your work currently provides you with insurance then use the money you are making and get a cab/taxi/bus/friend to the doctor/dentist. You whining about not being allowed to go and not taking yourself to these places shows your immaturity. This is what the judge will look at. And then s/he will look at WHY you want emancipated. Because your homelife stinks is not going to cut it.

Although Texas juvenile courts don't have jurisdiction over a seventeen-year-old, so as to treat running away from home as a status offense, there is nothing in Texas law that would prevent a parent of a seventeen-year-old from dragging a runaway, kicking and screaming, back home.

Even if you are emancipated, a landlord may decline to enter into a lease with you before you reach the age of majority. But if you manage to put together a petition for emancipation, you'll presumably have already located a landlord who is willing to rent to you such that you can document that fact to the court.

As a dependent minor, you're not eligible for low-income housing. You can't apply for a housing subsidy until you're independent. Also, the demand for subsidized housing typically significantly outstrips its availability. In most parts of the country, even if you were to petition for subsidized housing the minute a court granted an emancipation petition, odds are you'll be 18 before a space opens up. The Court needs to know that you're capable of actually supporting yourself, not that you can theoretically support yourselt at a future date if and when you obtain a housing subsidy.

Except that "plan" involves your quitting your job in Texas, and thus having neither housing nor a source of income to support yourself. When you petition for emancipation, you need to establish to the satisfaction of the court not only that you're capable of supporting yourself, but that you're already "self-supporting and managing [your] own financial affairs"

You have a job. You have income. You have your own health insurance. Yet you're complaining that it's your parents' fault that you're not obtaining timely medical care for your health issues? I very much doubt that the clerk can offer a standard form petition, but there's no harm in asking.

that was kind of a kiss off since the OP wanted to complain about everything. Most of what she needs is in the statute. After that, since she wants to argue how mature she is, I am sure she can figure it out.

When i say rationing, it means not buying junk and still eating the proper ammount and eating healthy. Means not buying cereal and cake or microwave burritos because it's more expensive than to just make days worth by hand, which tastes better and is much healthier anyways, i can't stand food that isn't made by hand, it almost always tastes like exactly what it is, junk, and upsets my stomach because of all the preservatives they put in them.
So what if i don't buy an 80 dollar shirt and don't buy new shoes every month? that doesn't make me look any kind of way, my clothes are still in great condition cause i take care of them, people can't even tell, i just don't accessories, other than vests, i love vests, they're comfortable.
I can't use my health insurance because at this point, if i spend my money, my mom gets mad if it's not being spent on someone else in the family, and she says i'm selfish. She eats up everyone's money that ever lives with her. They've both already threatened to kick me out for several reasons and i don't know anyone here other than co workers because i've only lived here for 6 months. I'd be on the streets like a stray dog. I wouldn't be able to even keep my job because i'd be dirty and my clothes wouldn't get washed cause i wouldn't have access to dryers/washers or showers.
And i don't have legal control over my medical, if she doesn't want me doing something, she can stop it quick as a lick. And i don't have transportation there, i live on a highway, a big one, and the nearest doctor is a 4 hour walk. Don't trust taxi's, especially not here.
And about the housing.
Georgia. Georgia. Georgia. I do not need subsidized housing in georgia because i make more than 3 times the average rent for an appartment there, and half the utilities are already payed in most places. That wouldn't require me quitting my job, it's called getting a job transfer. I've already spoken this over with my supervisor's boss. I can have my position transferred to another store in georgia and until they have a store that needs general management, i'll be an m.i.t, and they make the same income.

And it's not a "promise to a future promotion" the only reason it's not there yet is because i have to finish an online training course, which i actually just finished yesterday, i just have to turn in my resume, and i have the promotion, and by the time i go to fill out the papers, i'll have had it for a while.

Bottom line; don't need subsidized, not asking for it anymore, and i know places that would rent me a place.
Can't get to the doctor because i'm not allowed to spend my money and i don't have medical control over myself, so anything more than a check up more than likely wont be done without my parent's signature, or atleast as far as i've been told my whole life, that's how it works in most places. Don't know anyone to take me and it's 4 hours away of a walk on a HIGHWAY. And i'm never in my life getting in a taxi in this state, there is too much rape and kidnapping, and that's seriously just getting in a strangers car and paying them to take you somewhere cause they have paint jobs on their car.
Any young girl that gets in a taxi by herself is just mindless.
When i say rationing i mean that i'm not going to waste the money on cake and chips and useless things, and i'm not buying premade food. I can cook, it tastes better, it's healthier, and can usually can make a few meals, and if i like something, i want a few meals out of it. That's "rationing" to me. Pay 15 bucks to make enough healthy food for a family instead of 10 bucks for say.. a box of hot pockets. So i guess not rationing, more of being smart and not wasting money.
And clothes? so what? i don't care if people disagree with the fact that my shoes get dirty. I wear them till they're TOO dirty or they're ruined. My shoes still look like i've only had them for a few months, look almost brand new when i clean them off. All my clothes are in good condition and they look nice, i just don't look like i'm trying to be a model walking down the street like it's a runway show. I take care of my things.
None of that is wrong, at all. It's called not wasting money. It's highly immature and irresponsible to waste money, so i'm not sure why that's so bad to you that i don't buy 80 dollar shirts and 150 dollar shoes every few months.
So please just stop. The reason i'm still asking is because even though the stature is the law layed out, the sentences are so proper that they sound broken, and they're so flatly placed that it doesn't help as much as you think it does. It just says "a minor can do this when they get emancipated depending on this or this given they can prove a b and c."
That doesn't really say hey where should i go find these documents, what documents do i need to bring with me besides the obvious identification, who is best to talk to about this, and how long does it usually take to go through.
So PLEASE for the love of mercy, stop trying to bash me down and argue. I'm not dealing with it, i'm trying to get answers not "you can't, do this and shut up" That's not the purpose of this thread otherwise i would have said "should i get emancipated?" not "what do i need to do to get it?"

Again, you don't get emancipated based upon a fantasy of moving to another state, finding a cheap apartment and getting a job. To get emancipated you must prove that you are already self-sufficient and managing your own financial affairs, right there in Texas.

I lived in georgia my WHOLE LIFE it is NOT hot there like it is here, i'm constantly dehydrated here. i LOVE the humidity. It's dry as a desert here, except now that it's been flooding, something else i didn't have to deal with till i came here.
I didn't know i was medically emancipated here, in other places i'm not, and where i'm from in georgia, the water and gas is free in most appartments. The rent is usually 400-580, for one bedroom, sometimes two. And as a manager i'd be making a bit over 1500 after taxes.
I meant that i only need 50 for the phone because i don't like contracts, even if i had the credit, and then i was listing my other bills as internet and electric, not saying i don't like them, i need those. Not internet but it is very helpful.
I lived south of atlanta, and i've searched every appartment in the austin area, surrounding, there's only a few places, and the others are much too far from work.
I don't /need/ hud. DROP THAT because i don't need it.
Not having top of the line brand new clothes from hollister and all those other worthless brands doesn't mean i don't look nice. I mean if i need a dress or something really fancy, i'd get it fitted.
And i know my job is underpaying, my dad makes 3 times that as a manager else where, but all the other jobs here are taken or are also under paying, if not the same pay. So i'm not dumb and naive for settling on a job that can give me the pay that i actually need. Yes, a higher pay would be nice, but i'm not going to whine because i don't have the best job in the world, there are so many people that don't have jobs and i'm extremely grateful that i do. And i do know georgia has a huge unemployment rate, why do you think it's so inexpensive to live there? I have friends there who are struggling. But as i said, i would get a job TRANSFER. I would be ON FILE to work in another location, not quitting my job and trying to get rehired elsewhere, trust me, i know exactly how that works, my fathers managed different businesses for about 26 years.
Also, no, i'm not sexually active, i believe i have something wrong with my cervix/uterus, i get a lot of pain from them, and it's not cramps. They want me to be on birth control because of over frequent periods, but my mom wouldn't allow it, and as i said, i didn't know i was medically emancipated, i assumed since i can't do anything else until i'm 18 that i can't do that either because in other places i can't. And it's 18 in georgia, where i grew up. Also, yet again, 4 hour walk to the nearest family doctor, hospitals and gynos are further. On a highway.
And the acid reflux? i avoid several different foods so that it doesn't act up. And those relieve heart burn, not loss of appetite and constantly feeling full after about 4 bites, the other symptoms are fine, but nothing over the counter has worked for the other issues, i've tried several, even the most recommended. Might not be related to my acid reflux since it doesn't work, but that's what a doctor told me the one time i actually got to go when i was staying with my brothers. By the way, i payed that several hundred dollar bill myself, for a 30 minute checkup on my stomach.
You obviously live in some "super special" area in georgia. Either north of atlanta or the south end of the state, i'm assuming, usually those areas are full of overpriced or luxury housing.
As far as me making 3 times the rent? that's not delusional. say the rent is around.. 500, a common rent price there, multiply it by 3, what do you get? 1500. What will i make? 1.5-1.6. How many times the rent is that? just a bit over 3.
Internet isn't over 100, i wouldn't use a lot of electric, so probably about 150, maybe a bit more but anything above 200 is stretching it.
And phone bill.
That's 300 in utilities, 500 in rent. That's 800. I'd only be spending about 300 on food a month, i'm one tiny girl and i don't eat 5 times a day.
That's 1200. That leaves me with a bit over 300 to just do whatever i want with. More than likely into saving or if i do need something else.
I'd be fine as far as living costs goes, like i said, several apartments i know of include gas/water. There's 3 in particular i know are very nice and affordable with great management that i can live in easily, i've known people who live(d) there.
I'm sorry that the statues sound broken, and excuse me that i am TRYING to do research. What do you want me to do? Pull the facts out of thin air and read the same page 60 times until i magically know every little detail? The statue doesn't give me every bit of information i need, it gives me the basic lay down, and i have more questions that no one on here wants to answer because they're too busy arguing instead of helping at all. Believe me, I have children older than you. You can't convince me you know what you're talking about better than adults that have been on this earth, lived on this earth and worked in the court system longer than you've been born. GA isn't cheap because because of the unemployment rate genius, it's cheap because of where it is and it's proximity to other things. Not to mention the fact that southern states don't import as much crap as western states do and the regulations are looser. They also tax EVERYTHING as opposed to states that tax certain things. Your food is taxed here, where in some states it's not. Your clothing is taxed here where in some states, it's not. Your OTC medications are taxed here, where in some places it's not. You've got issues with your woman parts and reflux? How do you think you're going to be treating that with that $300 (minus the stuff you didn't think of)? Copays, medications, hospitalization, surgery in case they find something in your parts that mysteriously won't go away. People in my household have reflux and have had reflux since they were babies. Miraculously, the prescription medication that we have in the house is OTC. We only have a script for it because it's cheaper with our insurance *but you have to have a real good, high paying job to have that kind of insurance*. I guarantee you your job that pays below the poverty level doesn't have good insurance. Oh, BTW... your dad's $4500/mo is still not an amount that impresses me but it's a whole lot more than you make.
You'd actually have to live a little in order to know that.
