Caught With Heroin After a Traffic Stop
My question involves a past charge and one I should have coming. im very confused. In Ohio, now its been a couple months, i was pulled over (all legal driving wise). It was for illegal lane change, i wont argue that charge. One "cap" of heroin was found when i was pulled over. I even admitted it was from the day before, but never said it was mine. (it was, and im not trying to fight it) the officer cut me a break for not being a asshole pretty much, so i was booked and released for the traffic charge. the officer told me that i would probably be charge with the narcotic (would be a felony5 poss.) at a later date. so my first court date comes, and i show up and plead guilty on the illegal lane change, they reject my plea, how can they do that???? also ive been told i have warrants in another county in ohio, im not a runner, so i called to try to find out and they wont tell me nothing. im 500miles away from there and id turn myself in if i knew but i cant afford to go there just to have them run my name......and i dont want to goto a police station where i am and end up being booked, then go through all the extradition stuff...

Then hire a lawyer to sort out the mess you created.

A lawyer will be advisable. There months is NOTHING with regard to felony prosecutions.

What was the point of your reply? I admitted im wrong, im asking how a plea can be denied when I plead guilty......im asking for help, not what i know i already need to do.

I understand the lawyer being advisable, but the last sentence makes no sense to me....

The last line is that it can certainly take three months to charge you for felony crimes. They'll typically have the entire case laid out before they go for the indictment. They declined your plea on the lesser charge because they do not want to run afoul of the double jeopardy provision and potentially lose out on the heroin conviction because you plead guilty on the traffic violation.
