I have seen where children go in state custody in KY, and if you had then you would understand why it may be preferable to leave her in filth with her mother than to send her into filth with strangers. I did not ask for your judgment, just my legal options. Thank you.

Actually I have seen it. I've been a foster parent, my parents were foster parents and I have 2 adopted siblings. I interned with DCFS while in college. That's like saying I'd rather leave my child in an abusive situation unless she can definitely come live with me.

Ok, I my parents were foster parents, too. Their home was nice and clean. There is no guarantee that my daughter would go into such a home. My question is regarding my legal rights. If you cannot address my question, please refrain from replying. As I have stated, I am not interested in your opinion of me. I will not debate this issue further with you. Thank you.

Knock if off, Junior. Don't be rude.

Right. So we've established that you're Dad. Good. Now, you WILL have to answer this question in family court, okay?

What have you done about the alleged neglect? If the answer is "nothing....I just took photos..." you're going to fail.

Please tell me you understand that?

Ok, so what should I do? I am willing to go over to her house and clean it so that my child won't live in filth. I wanted to take the baby with me, but my attorney said that because I am the one who left I cannot do that. I'm just not sure where to go from here, and cleaning her house for her is not really a permanent solution.

Yeah, you really need to kill the attitude. You don't get to dictate who answers you here and how.

And quite honestly, if that's what your attorney told you (and not just what you think he said) then you need another attorney

I really just want to do the right thing for my daughter. I am scared and I do not want to do something that will end up hurting me legally regarding custody and visitation. She is my daughter, and I would do anything for her, but this is new and confusing and overwhelming and a little bit terrifying.

I don't know why you think I'm being rude because I do not wish to be told that I'm a lousy parent and just want my question answered without a lecture on my judgment of which you know nothing. My name is not "junior." Because you are "senior" members does not make you more intelligent or better people than I. I am seeking help, not judgment, and that is a reasonable request as that is the intended use of this forum.

My attorney said that because I am the one who left the family home, I do not have the right to take the baby.

If it's bad enough that you're worried about the child, you contact CPS.

If it's not, then you help Mom sort out the house. She may be feeling overwhelmed too - you might be surprised to find that she's more amicable when you offer helpp rather than threaten her with a custody suit.

    Y'know?
