Getting a Custody Order for an Infant
My question involves a child custody case from the State of: Kentucky
My attorney said I cannot get custody of my daughter because I work 12 hour shifts. I left a month ago but was told I could not take the baby. Since I left the condition of the house has deteriorated and is not fit for human habitation much less for an infant. The house is very dirty with several cats who are no longer being cleaned up after. At what point do I have grounds for an emergency custody order?

The important question here is proof. Do you have any? Have you called child services to alert them?

I have proof. I have not called child services as I do not want my daughter to go into state custody. I'm not sure what will happen if I call child services.

What do you have, and why would a court find it to be compelling enough to modify custody? What's your plan to be able to care for the child if custody is modified?
Is there a custody order in effect, temporary or otherwise?

The important thing isn't about you or the other parent - if the situation is that bad, it doesn't matter where your daughter goes initially. The important thing is her welfare.

There is no order in place yet. The proof is photographic. My sister is a stay at home mom and will keep my daughter while I'm working.

We are still married legally. I am the husband and father and am on the birth certificate. There is no custody order as we are not yet divorced. I have photos of the condition of the house. My attorney says that I cannot get custody because of my work schedule.

Then it doesn't appear to be much of an emergency because quite honestly, if my child was living in all kinds of filth and it could potentially hurt her or her health, the important thing would be for her to get OUT OF THERE. Once you're truly worried about the child, call CPS.

I have seen where children go in state custody in KY, and if you had then you would understand why it may be preferable to leave her in filth with her mother than to send her into filth with strangers. I did not ask for your judgment, just my legal options. Thank you.
