Pregnancy After Children Were Taken by Protective Services - Will They Take the Baby

My question involves child abuse or neglect in the State of: Tennessee

I have 3 children that my mother has custody of since about a year and a half ago. I was found doing cough medicine and they took my children away and put them into my mother's care. I still have supervised visitation and I am currently taking mental health for anxiety and depression and drug classes to fix this problem and to get my children back.

I know this is a bad situation but I am trying. People make mistakes and no one is a bad person. People just make bad decisions. You are only a bad person when you don't feel bad or make an effort to make things right again. So if you are coming on here to judge me then don't bother. I am going to keep doing what I am doing and striving to get my children back no matter what anyone says or how many people put me down.

Now back to the story... This is the problem I am facing...
I am currently 5 months pregnant. And the state, DCS, juvenile court, social services, my mother, NO ONE KNOWS except my husband.
I am keeping it like that because I am terrified that if the state does find out then they will jerk my son or daughter from me while I am in the hospital as soon as I give birth.
I am clean and have been clean for over 6 months. I have done regular drug screenings and of course prenatal doctors test you for foreign substances.
My case is closed as of right now with my other 3 children my mother has custody of. I have heard if the case is closed then they should let me keep the new child because I have not currently did anything wrong when this child was in my custody.
I am not sure what to do but I am terrified for them to find out. I don't want my baby snatched away at birth for past mistakes that I am currently fixing and been clean for 6 months.
What will happen? Has anyone ever experienced this?

Honestly? 6 months is not a long time in terms of sobriety.

What's more troublesome is that you're trying to rationalize. Yes, people make mistakes. Yes, people make bad decisions. But you're actually saying it doesn't matter what you do because it's okay as long as you feel bad. That's not how it works. At. All.

I believe that once social services find out, and decides that you've deceived them they might actually do more than remove the new baby....you keep going like this and you're going to lose all of the children permanently.

You need an attorney, and counseling. Not necessarily in that order.

Where do you plan on having the baby that you think they won't eventually find out? If you check into a hospital, they'll know INSTANTLY.

You say the case is closed, is there a case plan? Do you never intend on regaining custody of the other children? If the case is closed, I guess that means no, right?

If there IS a case plan, what has the court said you need to do in order to regain custody of your children?

Why doesn't the father of the other children have custody of those children? Is that man the father of this baby?

And so you know, you do NOT get to dictate how people respond to you on this forum. You'll take the good with the bad, or you go pay someone for advice. It is HORRIBLY irresponsible for you to make more babies when you can't take care of the 3 you already have on this earth. What kind of job do you have that will allow you to afford 4 children? There are bad people in this world. That you don't want to admit it because that will require you to take a good hard look at yourself is no one else's problem but yours. Denial will get you nowhere.

I know of a person [couple] they took the baby straight from the hospital. Ironically enough 10 years later they just granted them full custody of 2 children that were grandchildren of the father.

What kind of a job do you have that will allow you to support 4 children? How do you intend on supporting 6 of you?

Yes I have 2 jobs and my husband has 2 jobs.

I suggest you take a course in Basic Etiquette first.

and trying to go back to school? I am trying to discover cheap and endless supply of energy to run the world but alas, until that happens, means I have not actually done it. Same thing with your school; until you are in school, well, it's just talk.

So you live with your husband and a roommate with a child. How many bedrooms are in your home currently?

Your husband works 2 jobs and you work 2 jobs. Both of you are required to take classes. What is your plan for childcare for 4 children?

You indicated in another thread that your husband works a pretty low paying job and is obligated to pay $200/mo in child support. Have they assessed your support amount yet? You'll need to deduct that from your income.

At the time the children were removed from your custody, did they assign you a public defender or other attorney?

Volunteer who is trying to make a point.

Versus

Addict parent who unfortunately still displays signs that she has not learned from the first set of mistakes and is making the state's case for them, all the time while not wanting to pay support.

Makes sense to me.

I have no idea why you keep bringing up this working for the state thing. Do you put some special status on people that work for the state? Do you idolize state employees for some reason? It's starting to sound like you have some weird fixation with state workers. Is your husband aware?

You know, I'm generally sympathetic to people with addiction problems. Addiction is a crappy disease to suffer from, and it's hard to get clean. I get it. But your over the top belligerence because people aren't telling you what you want to hear makes it tough to give a single damn about your problems.

We both know that the removal involved a lot more than your being "found doing cough medicine". Your addiction was to the point that you were unable to care for your children, and your husband was either unable or unwilling to care for the children during your recovery. (Is he the father of the children who were removed?)

Sure, but not all mistakes put children at risk. The state didn't remove the kids simply because you are addicted to dex. They removed the kids because you and your husband were incapable of providing proper care for your kids. We have no way of assessing whether that problem has resolved itself.

Odds are you're on your state's central registry due to the removal and, if you do not report the pregnancy to the case workers, provide reasonable assurance that the baby will be safe, and create a care plan before the baby is born, upon the child's birth you will be looking at an emergency petition to take your child into care. You should be working with your lawyer from the prior case to try to work toward reconciliation and to provide assurances to the case workers that you are now a safe parent and, if you relapse, your husband will be both able and willing to protect and care for the children.
