    Buyer is Disputing a Credit Card Charge for an As-Is Vehicle
    My question involves business law in the state of: PA

    On March, 19 2014, a customer had purchased a vehicle from our dealership. Purchase was made by credit card. Both parties (seller and buyer) had agreed that the vehicle was sold as is. As of today, I had checked my bank statement and a huge chunk has been withdrawn. Called merchant and found out that the transaction on March, 19 2014 was disputed. Customer complained about problems with the vehicle. Never returned our vehicle. Still driving our vehicle for free. With a vehicle being sold as is and showing proof to the merchant with a letter/copy of all the documents can the merchant service reverse the decision? What proper way should we handle this matter? Thank you.

    You would start by trying to get the credit card company to honor the charge. If that fails, you'll have to consider suing the buyer.

    Send that letter, and a copy of all documents to the merchant. They should deny the buyer dispute based on that documentation. Even if the car was not sold As-Is and there was some kind of vehicle issue the buyer would have a hard time with this dispute as they still authorized the charges.

    If the dispute is upheld, and the money is refunded to the buyer then it is time to sue.

    Yes, the CC company can rule in favor of its customer no matter what documentation you provide.

    If that happens, you sue the customer.

    Why didn't you get notification from the CC company that a dispute was opened, the law requires them to contact you in an effort to resolve the dispute.

    You are also entitled to attempt to resolve the problems with the merchandize that was purchased e.g. make repairs.

    Buyer can not keep the car if it is not paid for under any circumstances. It could rise to the level of theft just as if someone buys merchandize with a check and then stops payment and doesn't return it.

    Look up the CC laws and regulations on disputes in PA. There are time limits to resolving disputes.

    Here is the visa handbook on chargeback. Start reading on page 49. I would think that all CC companies have similar policies.
