Is Emancipation Possible?
i am 15 and am a resident in Missouri. I am considering emancipation because my parents have been in a three year still running court case. I know my mother would support my decision and I think it might be the best option. My mother would also support me financially and with a place to live. The issue is my father. He is emotionally abusive to me and even though i have asked many times will not end the case. I also do not understand why the case isn't over with. There have been hearings scheduled about every three months and either nothing happens or someone doesn't show up or it is continued. This case has caused my mother and i to have severe depression and i have also self-harmed because of the case. I also find my GAL has not represented me truthfully and I have had many other psycholigists misrepresent me, though i have stated the opposite. Please respond with the best answer you can.
Re: is emancipation possible in this case?
Withuot goping past your first few lines I would say no Emancepation requires you be 100% self supporting if your Motehr is helping you you dont meet criteria. I also se your 15 most states require you be a minimum of 16 with some exceptations. Your case issues should be dealt with through your Attorney and or CPS if your Father is abusive. What I dont understand is why emacepation what ti seems your after is NOT living with your Father. Regardless you dont meet emancepation requirements
Re: is emancipation possible in this case?
I think emancipation may be the only way for me to get away from my father. He is obsessed with getting custody of me. My Attorney is not helping me at all and the judge is biased. My dad and GAL (attorney) have also tried to make it so i cannot see my psycholigest.
My state does allow emancipation at 14 and I could get a job if i needed.
Re: is emancipation possible in this case?
At 14!! thats unlikely but if you saw law. However it would most likely cause you to leave school no judge would allow that! Your best bet is still within system. By the way your only 15 your preception of how system is working and bias is bias yourself. I cannot see you getting a job that will allow you enough money to support yourself 100% teens make minimum wag and even at 40 hours you wont survive. Let the system do its job hire a new Lawyer if need be and if your Father is abusive get CPS involved they will work for you and your best interest
Re: is emancipation possible in this case?
According to the ACLU of Kansas and Western Missouri,
Quote:
Quoting Missouri Emancipation Law
In Missouri, a minor may be emancipated in one of three ways:
1) your parents may give express consent to a court that they are waiving their parental rights;
2) your parents may give implied consent, which would apply in situations where you have been living on your own, supporting yourself, and for all practical purposes your parents have relinquished their parental rights; and
3) you experience a significant change in your societal status-such as an enlistment in the military or marriage.
As in Kansas, emancipation requires the ruling of a judge.
From what you say, you have neither express nor implied consent, and are not eligible for marriage or military service. What law is it that you believes would permit you to emancipate?
