Drug Possession Charged As Intent to Distribute
My question involves criminal law for the state of: New Mexico
I was caught in my dorm room with about 2 ounces of marijuana. It was contained in 2 jars, which the officer told me looked suspicious. I told him that I didn't see how a glass jar was suspicious as they were bought that way and that jars are about the only thing to control the smell of potent marijuana. Of course there were no baggies, scales, etc. I didn't have cash on me, just my credit card.
Now I got a letter in the mail telling me to attend Arraignment for an Intent to Distribute charge. That is crazy. Any advice?

Follow Missy's advice. Splitting across multiple packages is often construed as intent. Distribution doesn't necessarily mean sale. Sharing with your buds is distribution.

It's not like you have a pound but two oz is a lot of bud,most people with that much are selling most of the times. Maybe with a lawyer this can be reduced to a possession charge. According to the site just possessing that amount should be a higher misdemeanor possession charge. Hopefully it can get reduced or maybe your state has a diversion program to avoid a conviction.
