    My question involves criminal law for the state of: South Carolina

    A few years back my ex-husband and I were at the start of our divorce. I had moved out and had my own place. Apparently the house was heading for forclosure. He went through an organization to get help to save the house. In doing so he made false claims; stating that the kids and I were living in the home and gave the organization the kids and mine social security numbers. Is what he did illegal? If so what am I able to do about it?

    You need to talk to your divorce lawyer. You need to understand that trying to dig up old grievances to get your ex- into trouble is likely to be a fruitless exercise.

    At its worst, it could end him up in jail and you without child support for years. Sometimes one forgets the effect their actions will have on themselves.

    yes that is welfare fraud, he will owe back the money he recieved and face jail time too.

    If the divorce was not yet COMPLETED, it may not have been fraudulent information. If he was ordered to pay child support or alimony, the same may apply. If YOU received any benefit from the house being saved, YOU may be on the hook for some repayment as well. BEFORE you start a quest to get your ex in trouble, you REALLY need to consult with a local attorney to find out how the making of such a claim may impact YOU. And, unless you've got serious kick-ass proof of BLATANT fraud in his part, you bringing this issue before the court could seriously backfire on you as an attempt to keep him away from his children. Do NOTHING until you take whatever PROOF of fraud you have to an ATTORNEY for review.

    I was not in the home when this was done. I just recently found out he did this. When the IRS sent me a letter stating that they are auditing me going back to the time my ex and I where married. He signed my name to tax documents without my knowing and made claims of out of pockets expenses that were false. I called an organization to obtain assistance with legal services and found out that I could not use their services because I had already used their services apparently for the house foreclosure issue. I told them that I was not aware of what they were talking about nor was I even living in the house when their servises were rendered.

    Again, the old I know nothing may have worked on Hogan's Heroes, but you knew those tax returns needed to be filed and either signed, gave permission for him to sign or failed to legally file your tax returns. The IRS hears the same story time after time.
