Child With Severe Behavior Problems Wants a Change of Custody
My question involves a child custody case from the State of: California

This is regarding my sister in law. Her mother left her father for another man who made a lot more money. Her dad gives her mom $2,000 a month in child support and spousal support. She just found out about the affair and that her mother doesn't save any money for her and the punishments they give her for failing tests are unheard of. Her step father is a monster and has taken away literally everything that isn't a necessity in her life and I'm afraid that if she stays there any longer she'll be in with the wrong crowed soon enough, start rebelling, and getting horrible grades.

The daughter of the step dad is now in and out of rehab, quit school, and has had 3 babies with 3 different men. We don't want her going down the wrong path. She wants to live with her dad so bad but during the divorce and custody judgement, the step dad pegged the father as a racist and they proved that he told them what was going on with the divorce. Telling the kids the truth when they asked was apparently the wrong thing to do.

The step dad has told this girl several times that he can make her life hell because he has a lot of money that can pay for the best lawyers known to man. What would happen if she just left her house and didn't turn back? If her mom called the police would they be able to take her back there or would they have to let her go with her father?

Necessities are all that's required, legally speaking.

They'd take her back to Mom's, and she should expect "Garden Of Eden"-esque punishment. Anyone harboring her can face felony charges.

She is not entitled to the child support - that's to reimburse Mom.

See answer in other thread. Her intentionally trashing her grades in protest is not going to sway a court. If you really want to help her, assist and enable her to pass the tests instead of fail them.

Oh my god do you people not read the responses? It's not her grades that starts the abuse! Jesus Christ, even if it was do you think that it's okay for someone to tell a child to kill themselves because of a C????

I've grounded my child for C's. I don't raise average children.

    She's 13.

13 year olds, for the most part, are generally pretty adept at manipulation.

    It's just a thought.

LET GO OF THE WHOLE GRADE THING PEOPLE. It was a simple and very minute example. She goes to bed without dinner if she simply forgets to flush the toilet but that's not the only thing I'm writing about. I didn't want to put every example for the fact that this post would have been 100 pages long.

Bottom line: if Dad wants to change custody, he needs to go to court.

    That's it.

And the court is not going to take the minor's word as truth.

And NONE of it changes the legal answers you have already received.
