Going to Court for Repeated Speeding Offenses
My question involves a traffic ticket from the state of: Ohio
I've recently received my third traffic ticket in Ohio, and am now required to appear in Dayton Municipal court.
I have never been to court before and would very greatly appreciate some insight into what will most likely happen.
I'm hoping just a heavy fine and points, or hopefully traffic school.
Is more possible/likely?
Re: 3rd Speeding Ticket in 12 Months in Ohio
OH cans your license at 12 points in 2 years. You get a warning letter at 6. I've never bothered to appear except to fight a ticket. No reason to, unless it is mandatory appearance.
Re: 3rd Speeding Ticket in 12 Months in Ohio
It's a mandatory appearance.
Re: 3rd Speeding Ticket in 12 Months in Ohio
This is your third ticket, what were the infractions and in what time frame?
Re: 3rd Speeding Ticket in 12 Months in Ohio
May, 2013 - 80 in a 65
June, 2013 - 70 ina 55
April, 2014 - 81 in a 55
Re: 3rd Speeding Ticket in 12 Months in Ohio
Being that this third violation is within one year of the last two violations issued for the same violation, the judge may consider you an habitual offender and sentence you to a third degree misdemeanor (4511.20). I think you may just face some jail time.

Is jail time really likely for speeding?

For a person caught speeding, no. For you, yes. This is your third offense within a year. You're not going to court for a few miles over the limit, you're appearing for 25+ MPH over the limit with two prior convictions within a year for the same numbers.
The judge already slapped you on the wrist (twice) and you still haven't learned. How do you expect to learn?

How much jail time?
Would an attorney be a wise investment, or am I pretty much up the creek either way?
Re: 3rd Speeding Ticket in 12 Months in Ohio
Up to 6 months. I wouldn't climb one step of the court house without an attorney representing me.
