Emancipation for a Pregnant 17 Year Old
My question involves juvenile law in the State of: West Virginia
I'm wondering if I would be able to get emancipated quick and easy.
I'm 17, and pregnant. I OWN my home, and the father of the baby and I are engaged.
The father has a stable job, and I'm about to start working at a daycare.
Money and food aren't a problem, we don't receive help from the state.
My parents approve of my relation ship with the father. We haven't told them i pregnant yet I'm afraid,
His parents know and support us. My parents on the other hand are divorced and I don't live with either of them.
I don't smoke, or do drugs, or drink alcohol. Neither does the father. My parents aren't the best role models.
My father has a abuse, and drug background, and my mother has gone off the end since the divorce...
She's gone "boy crazy". I have proof of my stable home and job. And was wondering what I would have to do to be emancipated, and if either of my parents could interfere with it.. They aren't stable to look after themselves honestly.

Also the father is 20 and in the military, my parents no we are sexually active. ((Recently) about two months after my 17th birthday I became sexually active)
The consent law in wv is 16.
And he isn't breaking any laws.

You cannot enter into a legally binding contract, so how do YOU "own" your own home?
Are you living on your own already? How long have you been living on your own?
You will have to check with the local court to determine what must be done to petition the court for emancipation. It may take time to get any requirements fulfilled and it is possible that you will be 18 by the time this might get scheduled for court anyway. If you are already living apart and on your own WITH your parents' apparent de facto consent, why not wait until you are 18? You avoid a lot of hassles that way - and, it will be cheaper.

By "owning" my home I was signed onto the deed. My fiancé and I worked our asses off. He bought the home with both of our money. And we bought the home off one of his family members. Thank you for not thinking of anything like that. And I've been living on my own since I was 13, met my fiancé when I was 15 moved in with him after we purchased the house. We just purchased the house a month before my 17th birthday in 2013. Before that I was being mentally abused by my mom, her bf, and my moms side of the family. I HAD seizures because of the stress. But now that I'm not near the stress I don't have seizures anymore... Sorry if I seemed rude.

Oh, I THOUGHT of it, but you said you OWN your own home ... that usually implies that the person making the statement bought it, not that someone else did and they had their name placed on the deed or in trust. Technically, HE bought the house because - I presume - he is of legal age, you are not.

That could be a problem ... how old is this "fiance"? If you guys hooked up before the age of consent he might face criminal liability if this emancipation matter becomes a big legal issue. Because of that fact, alone, you might want to consider just leaving it alone and quietly letting your 18th birthday come along. And, hopefully, an actual marriage will occur after that. Statistically the odds are not in your favor with regards to your staying together, and only being married will grant you - and the child - the legal protections that you might need should the relationship fall apart.
Since you are living on your own and, if true, supporting yourself with your own resources, you might be able to get emancipated by the court if mom and dad don't object. But, what's the rush? Why spend the money and time to do this if you are going to be 18 in a few months? Going to court could open a can of worms that you - and your boyfriend - don't need.

She doesn't appear to be supporting herself with her own resources seeing as if she is "about to start" working at a day care (which isn't a wonderfully paying career). It appears that she is supporting herself with her boyfriend's resources which would not make her self supporting.
I'll save the commentary regarding her attitude.

You have a legal problem with that right there regardless of how it was paid for. West Virginia does not allow a minor to own property in their own name. It must be structured in an UTMA or UGMA manner.

you don't have seizures from just stress. If that was the case, I would have been having continual seizures for 30 years, ever since my children were born. If stress triggered seizures, there is an underlying medical issue that needs to be addressed.
You really should read CDWJava's posts again. He is making the suggestion of not making an issue of this due to possible illegal activities that have taken place. On top of everything else, since he is military, what is happening or has happened can be a huge problem for him. You should consider the consequences of bringing all of this to light before you turn on that switch since once it's on, you can't turn it off.

Given that a teenage pregnancy generally indicates the need for more supervision, not less, the chance of any pregnant teenager being married, regardless of assets, is slim at best.

Since she seems to be somewhat emancipated, the court might grant the petition. I think it would be better to obtain parental permission to marry and solve the problem or wait until age 18.
