    My question involves guardianship in the State ofNevada. I'm 17. My mom passed away and my sister became my legal guardian. This process took placein California. A year later they decided to move to nevada. I am not physically, but I am Mentally abused by her and her family. I really dislike Being here and with them. I have been considering getting emancipation and moving back to california. About money, I have received a compensation for my mom's passing. However I do plan on getting A part time Job as well. What does the law suggest or say about this? I know many say it's better to wait, but I can no longer.

    Was the guardianship transferred to Nevada?

    How long until you turn 18?

    Is the compensation you received enough to pay ALL your expenses until you turn 18?

    If the answer is no, then don't even bother thinking about emancipation until you have a job paying enough which, when added to that compensation, will. The law says that in order to be emancipated you must be able to be self-supporting.

    Ah, "mentally abused" - the state of being for most any teenager in the world.

    In addition to the question of whether guardianship has been transferred to NV, are you currently working (I presume not as you are considering a part time job)? Are you living on your own? Do you have the ability support yourself 100% without government assistance and without moving in with a BFF or boyfriend/love interest and/or their family?

    You are not a likely candidate for emancipation. And, it is just as likely that you would be at or near 18 before you could ever get this matter before a court of competent jurisdiction.

    Even if you are truly abused, you won't be emancipated. We don't turn abused children out to fend for themselves, we place them in alternative custodial care.
