Job Offer in Texas
Hi!
I recently received a job offer in Texas. I currenly live in MN. The custody situation is tricky and I'm not sure where to start.
1)I have sole physical and legal custody of my 8 year old. I'm pretty sure her father would agree to the move. Would I still need an an attorney to update the order or if we agree on a new visitation schedule could we just rewrite it and file it through the courts somehow?
2) I also have sole physical and legal custody of my 1 year old and 3 year old. All four of us had an OFP against my ex husband (different father than my 8 year old's dad). He was granted supervised visitation once a week for two hours. He rarely made it for any of those visits. In June 06, assuming he completed chemical dep. treatment and anger management (he did not) I would determine if I was comfortable with unsupervised visits at that point. But in April 06 he moved to NY and hasn't seen the kids since.
a. Would I still need his okay to move out of state?
b. What is involved, timeframes etc, for filing for abandonment.
The new job offer is for July 07 so hopefully I have enough time to get everything in order. Please give me an idea of where to start with all of this!

Your safest move is to petion the courts for a hearing to modify your situation. with yor troublesome Ex not meeting requirements already being placed on him I doubt he can win if he fights this. I would also get something in writing from other Ex regarding 8 year old. That would be a different case but keep it in case things get ugly later you will then have written proof he okd move.

Maybe I should know this, and feel really silly asking, but how do I go about petitioning the courts for a hearing?
Would my ex husband then be served in NY with something asking him to appear?

Walk into the family court building go to clerks office ask for necessary paperwork and yes your ex will have to be notified by service
