Can You Revoke the Adoption of a Child, Adopted from Foster Care
My question involves adoption law for the State of: ND
hello, I adopted a child 3 years ago. I wanted a larger family, but ever since I adopted the child she has been defiant tword both me and my husband. I have tried everything to make things between us better, but even so she screams and complaines daily about little things. I have tryed to just deal with her and help her but she has drove me over the breaking point. my question now is if it is possible to send this child back into foster care, so we may live happier.
Re: Can You Revoke the Adoption of a Child, Adopted from Foster Care
Nope. Adoption isn't "child lite". This child is exactly as legally yours as if you'd birthed her yourself.
What types of family-centered counseling is your family exploring?

Children are not fish. You don't get to throw them back.

Just a thought. Have you taken her to the pediatrician for an ADHD work-up? Kids coming out of foster care may have hidden issues that counseling and medication can help. It helped with one of my adopted kids, even though it was a rough road for a while.
Good luck

Gosh. If she isn't messed up from all she's already been through, having her new parents throw her away ought to do it.
I know it's hard. Parenting is hard. What would you do if she was your biological daughter?
Re: Can You Revoke the Adoption of a Child, Adopted from Foster Care
If you have not lived in this persons shoes, dont condem her. I live in her shoes for 6 years and it is horrible to live with someone who is a compulsive liiar, destructive, impulsive and verbally and physically abusive to every one he comes in contact with. He also sexually assulted the 1 person who was trying to help him his adoptive parent. Now tell me about throwing back a fish. The system is so screwed up they do not have enough funds to provide adequate care for these children and they pass them on to unknowing eager, innocent individuals who just want someone to love. Do judge when you have no idea what you are talking about.
Re: Can You Revoke the Adoption of a Child, Adopted from Foster Care
No one is condeming her - we are simply telling her the legal truth of the situation. Whatever problems this child has, they are HER problems to deal with, work through, commit resources towards, and seek assistance with. Raising children, whether one's natural born children or adopted ones comes with challenges, which is why the question has been asked, "What types of family-centered counseling is your family exploring?"

The "system" didn't force this child upon her. She willingly adopted this foster child. Foster children, by the very fact that they are IN foster care, PREDICTABLY have issues above and beyond what a parent could expect with their natural born children. It takes a special someone to adopt foster children. Sometimes they just don't start out special, but BECOME special as they work to parent a child with unique difficulties. But the legal answer remains the same.

Adoptions can be revoked.
OP needs to start looking for ND adoption attorneys.

Adoptions can be revoked.
Adoptions can potentially be revoked, depending on the full facts and state law. I wouldn't go so far as to say that revocation is going to be possible in every state, and I don't see authority for revocation of adoption in North Dakota. Consulting a lawyer would be a good idea.
