    Minor Caught Shoplifting in Ohio
    My question involves criminal law for the state of: Ohio

    I live in Ohio (franklin county)
    today I was caught at JCPenny, stealing 292 dollars worth of items. I was taken into the back, questioned by two employees, told to write out and sign documents that show i admit to and understand what i did, and the consequences, and then a cop entered and he also asked a few questions.

    This was all done without a legal guardian present, and I am a minor (age 15)

    When I go to court, can this be used to lower my fine/sentence

    They processed you, there was no requirement for a "legal guardian" to be present. Who were you released to?

    I was released to my legal guardian who came to pick me up. By the time she had arrived, I had already been questioned and asked to fill out the forms

    Your parent needs to hire a lawyer for you.

    $292...you're not a first time shoplifter.

    You can expect court costs, fines. The store/it's lawyers will likely send a Civil Demand notice. Your parents can ask a lawyer if the should pay this or not, but know that if a store pursues it, they can win a court judgement and screw up your parents credit rating.

    Other things that may happen: Community Service. Anti-shoplifting class. Probation.

    My post #1 stands. They did nothing wrong in processing you and then calling your guardian. If the police were going to take you, they wouldn't even need to call your guardian.

    Or, to put it more bluntly, No. You cannot use their processing you outside of the presence of your guardian to lower your fine.
