Can A 17 Year Old Legally Run Away in Oregon
My question involves juvenile law in the State of: I have a 17 year old daughter, who's father has done everything to keep her from me pretty successfully thus far. But recently I got on Facebook an had a request from her ( she created the account in secret to contact me), In one of the many attempts we ( Daughter and Myself) have tried to keep contact over the years. In each attempt my daughter an I have kept, He has found out. The Custody order gave him custody when she was 3 , While I was to have visitation, contact ect.. But each time I've located them. He up and Moves, Changes phone numbers, Changes her school, towns..ugh! . Mind you this has happened 5 times in the last 8 or so years. .. As the story go's .. She Contacted my Via Facebook, She tells me she wants to runaway and come to me ( She is determined to come home).. Bye all this happening over the years and she is sooo Close to her 18th Birthday now, can I get into any kind of trouble for having her here if she comes to me. This is Oregon, and it states that in Oregon , that it's not illegal to run away.. But is it if she comes to me, The noncustodial parent. Or will there just not be enough time for him to take any real action, being so close to her birthday. I Miss my daughter, She Misses me... and as much as I want to run up there and scoop her up with a huge Hug and bring her home.. Im terrified that this will cause her or myself more issues ( Legal issues even) at this point. Advice please... :wallbang: ..:(

Why haven't you enforced visitation through the courts? If he is breaking the court's orders, there are a number of potential crimes he could be charged with by keeping her from you and defying the custody orders. if there is no action being taken, it makes me wonder whether the court has actually agreed that you should have little to no contact.

Yes, you can. Until she is 18 there appears to be a court order in place granting dad custody. Even if she hides in your basement until she is 18 you can still be charged and convicted of violating the order, encouraging her delinquency, and maybe a few other crimes ta boot.

Correct. SHE cannot be put into juvenile hall for running away. But, YOU can be charged for encouraging or aiding in her delinquent act.
When she turns 18 she can leave home with the clothes on her back and move in with you. Until then, she is a minor and has to stay with whomever the courts have granted physical custody.

If she runs away and comes to you, if you want to avoid the potential of jail time (and a court order that might bar you from any contact with your daughter for a few years), you might want to call the local authorities if she shows up on your doorstep.
if she is being abused or neglected by dad, contact the local authorities where they live to investigate. If she is otherwise safe but just doesn't like living with dad she can wait until she is 18 and then bail out (gee, teenagers thinking the grass is greener with the other parent - who'd a thunk that would happen!!?).

I don't necessarily disagree with you but apparently dad has been playing "hide the child" for quite a while...and if the child is within three months of being 18, where do you get that she could be barred from contact with her daughter for a "few years"?

I have attempted to file several times to enforce this order, as I said before he moves, changes everything state, city , phones, schools jobs girlfriends.( At one point moved several states over) .. Cant file anything if I don't have some where to serve, and its been a major issue as far getting proper help. And as far as Little or No contact that is just a very far fetched idea . I'm far from being a neglectful in any manor.
2. I will NOT Aid her or Encouraging her as previously stated.( IE , Taking her from there to be at home with me or tell her its okay to do so.)

5. What do I know for a fact? As far as her being Neglected? .. He's Kept her secret, All I have is her word. .. Mind you this has all happened in 3 days of the most recent contact.

Thank you though.. I understand reading it isn't the same as being a witness to the situation. And I'm probably missing key information. Seeing how I'm not a lawyer. Even though My efforts were obviously unsuccessful, even poor... There never was a lack of trying to contact her find him.. redo the the Order.. But half the time I didn't even know what state he was in makes things slightly difficult.

If charged or convicted, a court has the right to issue a protective order. I know it can happen in CA - and HAS happened - so I presume that a similar option is available in Oregon.
There must be a reason that dad has been getting away with this for a few years ... I suspect there might be more to this tale.

This can be filed as a criminal matter, not simply a family court matter. Why haven't you reported this to the police??? Concealing a child from you and taking the child out of state to conceal it can be very serious crimes! I find it hard to imagine that the police and even the feds would completely ignore this unless there is some piece to this puzzle you have failed to share with us.
The easiest thing to do might be to wait a few months, and then when she is 18 she can contact you and you can send her a bus or train ticket and she can make her way towards you ... or, you can go to her and pick her up.
