    Allegations of Manufacturing Marijuana
    My question involves criminal law for the state of: nd

    My brother was under suspicion for growing marijuana, they had searched his home and found a light and some planting pots. His lawyer told him the DA is deciding whether he is going to be charged with cultivation. There were no plants or anything found, only what I stated and a person saying they seen the plants a couple years ago. Could they charge him with cultivation?

    Could they charge him? I suppose so. Whether they could secure a conviction on that...the crystal ball is out for repairs.

    If the pots were used to grow marijuana, odds are there will be trace evidence. Your brother should consult a lawyer.

    I see, so they wouldn't have to find plants in his posession/growing to convict him of cultivation. What I read of the ND law is that manufacturing/cultivation falls under the posession laws for sentencing, dependant on how much you were caught with. I may just be misunderstanding how this all works. Sorry for the ignorance on my part.

    Is the charge under N.D. Century Code Sec. 19-03.1-23(1)(b)?
