Can You Recover Attorney Fees if the Other Party Draws Out the Trial
My question involves a child custody case from the State of: Michigan
Is it possible to ask for an award of attorney fees in a case where the defendant is purposely dragging out the cross-examination to make the case go on and on? (they have no lawyer, so it doesn't hurt them at all) Thanks.
Re: Attorney Fees in a Deliberately Drawn Out Case
Yes, at the start of the case in your complaint ... if you did not ask for it there, I don't think it could be added later
Re: Can You Recover Attorney Fees if the Other Party Draws Out the Trial
You can certainly make a motion for abuse of process, however, it will likely go nowhere as they are entitled to due process. Your lawyer should make the motion.
