    Can My Daughter Leave Her Mother at 17 and Live with Me
    My question involves a child custody case from the State of: MN

    My daughter and her mom are not getting along. She turns 17 next week. Doesn't want to live with her mom. However her mom will not let her live with me. What course of action can I take.

    Teenagers "not getting along" with a parent is about as common as the sun rising, so this is not a huge surprise and not likely to convince a court to change her living situation or remove mom's parental rights.

    Since you refer to this child as your "daughter," and that she lives with mom, I assume you are dad and have (at best) visitation only.

    You are certainly free to speak with an attorney and seek primary custody. Until then, if she leaves mom and moves in with you, and this violates any court orders, YOU can be charged with one or more criminal offenses.

    So, either negotiate with mom, or seek primary custody. And, since MN appears to have no specific emancipation petition statute, the odds of her getting her situation heard by a court is virtually nil (based on what little info you have thus provided).

    Or, alternately, you can wait until she is 18, when your daughter can legally move out and live wherever she wants. As a former poster used to say, 17 is not 18 lite.

    For what reason does she not want to live with her mom?

    - My mom makes me do chores.
    - Mom makes me do homework.
    - I hate my curfew/strict rules.
    Not good reasons.

    My first thought upon reading this is what if you still lived with mom? If dd didn't enjoy living with you, would you just let her move out someplace else? If no, why? Maybe that will give you an idea of mom's stance on it.
