Caught by the Police With a False ID, Age Nineteen
My question involves criminal law for the state of: Texas
My son and friends were pulled over because 1 of the boys threw a cigarette out the window. The officer saw there were open containers in the vehicle. Each boy got a MIP and OPEN CONTAINER ticket. Upon search of the vehicle the office found 5 grams of cocaine on one of the boys. My son was asked for id and he told the officer he only had a fake one. This id was one did have his name on it and looked like a DL from another state. Of course he had intent to use it but luckily he did not get that far. The boy with the cocaine confessed to it being his. My question is only about my son. What can happen?

If he managed NOT to get charged for the fake ID, he dodged a major bullet. Even possession of an altered ID is a class B misdemeanor...serious stuff. He still could be charged but it's unlikely.
The other two offenses are both class C misdemeanors. Fine of up to $500 (each). If he's got an otherwise clear record, he might get a deferral: alcohol class, community service, etc... and if he keeps his nose clean, he'll escape a criminal record. He can count on losing his license for at least 30 days.

I am sorry, after re reading my question I see I did not make it clear. He admitted to the fake ID and went to jail for that so YES he was charged and we will have to go to court. He got ticketed for the MIP and Open Container. This is horrible and believe me, he will be the one paying. I in no way want him to not be held responsible but of course I am his mom so I am worried about jail. Is this something I should hire an attorney for? Thank you in advance for any advice.

Yes, if he is charged with the ID issue, he needs a lawyer. He can go to jail for it and even if he doesn't it will be a lifetime criminal record if convicted.

At 19, he has seriously screwed himself. A lawyer would definitely be a good investment.
