    Accused of Stealing a Bank Deposit
    My question involves criminal law for the state of: Minnesota.
    I was a District Manager for a restaurant and I was asked to take deposits for 2 separate stores. I went to the bank deposited the money and returned the deposit slips to the store. I was terminated 2 days later due to poor performance but now being accused of stealing a $1,200 deposit. The GM says there were 2 deposits but only one was given to me. I had a detective contact me and I gave him my story. Now I know i should have contacted a lawyer, which I have now done. I am worried about loosing my new job more then I am of being arrested because I did not take that money. I have a witness that was with me and saw me deposit everything that was given to me. Do they have a case against me, even though I was the one who deposited this money? Or am I in trouble?

    Does your lawyer know about your witness, if not let him know. No one here can tell if they have a case against you as none of us know any details. If you deposited the money then the bank should be able to verify that the deposit was made, that it was made into the correct account, and that it was the correct amount. If money is missing then it disappeared in one of 3 places, either it disappeared before you took the money to go to the bank, it disappeared while you were in control of the money, or it disappeared after you made the deposit. If the detective determines it happened when you were in control of the money then you are in trouble, otherwise you are likely fine. Don't talk to anyone (the bank, your former employer, or the police) without your lawyer present. Also if the name you are posting under is your real name I strongly suggest you don't provide any more details.

    Were the deposits in one bank bag or two? What kind of bank bag was used -cloth or plastic? Who verified the deposits before you took possession? If you returned the "deposit slips" to the store the bank will have a record of the individual deposits made. The bank teller would have logged in the deposit(s) and that record should be available for examination.

    I don't know long ago this took place, but banks typically keep their bagged trash for 7 to 10 days. If plastic bags were used they would be held onto for that length of time.

    Following up on that, sensible businesses don't just hand employees the deposit in a paper bag, but give the employee a locked pouch.

    did you steal the deposit?

    You are innocent until proven guilty. If you didn't steal the money, you are good. However, your writing style and verbiage indicates that you are hiding something.

    There is a point in the system where the money should have been short. On one end is the thief and the other the dupe.
