Eighteen-Year-Old Charged with MIP
My question involves criminal law for the state of: Florida
I am 18 years old and currently in Destin, FL and I was arrested Sunday for an MIP. We were at the beach and an officer approached me about not having glass which lead to my arrest. I was bailed out by my friends which cost $300 and i was told that would go to my diversion program. Last night I was at a party and the police arrived and gave everyone a citation and another $300. I had not consumed nor had i had alcohol in my person but I still received a citation. What am I to do? I can not afford a lawyer as my parents have essential told me to fend for myself. They too don't know about this situation. Is there a way I can make it one charge instead of two? Will i need an attorney? They told me to call back at the end of the week because they have not received my information yet. Please help me I am very scared and not sure how to proceed.

At 18 you can ask for a public defender. Most likely you've screwed the pooch on your diversion. What defense do you thin you have. If you had constructive possession of alcohol, you're guilty. You do not need to have consumed alcohol to be "in possession."

Well the cases haven't gone through yet and i haven't selected the diversion program. Is it possible i could get both of them under one if I talk to the prosecution?

It's quite possible that neither will get diverted now. You need an attorney.

2 MIPS in such a short time frame?
You need to get your ass to AA or Rehab. Talk to your Community Mental Health office about a treatment program.
