    i am also wondering how to change my daughter's surname to my own. we live in texas so maybe there are other laws that need to be followed. i was never married to my daughter's father, he signed an acknowledgement of paternity when i gave birth to my daughter. he lives in the philippines and was not here for the most part of my daughter's life. he does not send child support either. my daughter and i had to visit him in the philippines for my daughter's 1st birthday. that was the only time he spent with my daughter. pls help! i really want to move on with our lives and change my daughter's surname.

    Prior to the age of one it is possible in Texas to petition to amend a birth certificate to change the child's last name, without an additional court order, although that would normally be done to add the father.

    If there's a custody order, you would normally go to the court which granted the order and petition for the name change, showing that it is in the best interest of the minor child.

    If no formal custody or support order was ever entered, you would normally bring a petition for a name change in your county court, with notice to the father. Check with your county courthouse to see if they have standard forms you can use.
