Fiance Took Our 4 Month Old and Ran Off
My question involves a child custody case from the State of: Louisiana.
On Monday my Fiance ran off with our 4 month old. She took her to Mississippi. She abandoned all her private belongings and brought only enough diapers and wipes to last a few days. She has a criminal record from Nevada for assault. No job, staying with my father, and I have been the financial supporter of both her and our child since birth..
What can I do? I would like to get custody in the long run. But have her move back to a reasonable distance (Within 50 miles) or so. Please help.
Re: Fiance Took My 4 Month Old and Ran Off
Is paternity established? If so, when and how? Is there a custody order in effect? She moved how long ago?

If she did not take her belongings and only took enough diapers and wipes for a few days, what is your basis for assuming that she hasn't just gone for a visit?
Re: Fiance Took Our 4 Month Old and Ran Off
Regardless of whether she's coming back or not... head down to the courthouse TODAY and figure out how to file a paternity action. It'll take you at least a couple of days to figure it out. If she's not back by the time you finish filling out the papers and she hasn't called to tell you where your baby is and when she's coming back, file and ask for custody.
Period. Take no excuses.

She has since then told me our relationship is over.

Yes, paternity is established. I am on the birth certificate.
No custody order in effect at this time.
She moved 4 days ago.

Then you need to immediately file to establish custody.

That is where I am now. Trying to figure out what are my next actions. Because I don't know the steps. Like she took the birth certificate and SSC. Are they needed at this point? If so how do I get copies? Do I have, legally, a chance at winning this case? Someone help please.

Check your parish court website for forms and instructions. For example, here's the collection for East Baton Rouge and their generic petition to establish custody.
