B1 Visa Got Cancelled at the Border
Hello,
In wish to visit my family in the US again this summer, but my visitors visa got cancelled at the border the last time in tried to get thru from Canada. They found out that I had a baby in the US early on. Baby's dad is a US Citizen and wanted to have the baby in the US rather than in another country. I want to be there on his birthday this summer. I want to know if what are my chances in getting approved for a B1 Visa
Re: B1 Visa Got Cancelled at Border
Slim to none. You appear to nave immigrant intent. Lots of prejudice against "anchor babies" these days as well. It's certainly going to take a lawyer.
Re: B1 Visa Got Cancelled at Border
The cancellation was predicated on INA Sec. ____?

OK, have no intentions of living in the US, how can I get my baby back? I just wantby baby back. It was a mistake on my part for trusting the father of the baby. We're not married and I just want my baby back.

The child is now how old, and has been living with the father in what state for how long?
Your visa cancellation was predicated on INA Sec. ____?

6 months old, Michigan. Visa cancelled 22CFr 41.122(h)(3). :(

(h) Revocation of visa by immigration officer. An immigration officer is authorized to revoke a valid visa by physically canceling it in accordance with the procedure prescribed in paragraph (c) of this section if: ...
(3) The alien is notified pursuant to INA 235(b) by an immigration officer at a port of entry that the alien appears to be inadmissible to the United States and the alien requests and is granted permission to withdraw the application for admission;
If you were given permission to withdraw your application for admission and did so, there would be no direct penalty from that withdrawal. However, it's another entry in your immigration file that will be considered when you next apply for a visa or for entry.
Given that you seem interested in litigating a custody case, and there's a big shadow hanging over your ability to successfully enter the U.S., I suggest that you start building a legal team: a custody lawyer for your custody fight with dad, and an immigration lawyer to help you navigate past issues and to get permission to be present for legal proceedings.

Yes i was given permission to withdraw. Will they still know that i had a baby there? Is getting a legal team the ony way i ciuld get a visa?

Yes i was given permission to withdraw. Is getting a legal team the only option i got?
Will a k1 visa be ok? Going thru litigation or custody battle is not really an option for me right now, coz i know that would cost a lot. Any suggestion will be appreciated, thank you
Re: B1 Visa Got Cancelled at Border
If they know you have a baby, they know you have a baby. We are not in a position to advise you as to the odds of your being issued another visa - all you have told us is that your history created enough questions about your intentions that you were denied entry, which of itself suggests you need a lawyer.
