Quit with the DRUNK defense please! Listen to what I am telling you yes find a Lawyer you can get one free office visit that should help! Check into diversion that could help you avoid a conviction on your record. If you have a drinking problem then yes attend AA it works I should know I am a 20 year sober alky!Please please stay away from the drunk defense! Do what I say check your states shoplifting laws! If concealment is a crime you could still be guilty and your drunk defense willwork againist you as you were too drunk and stupid to realize the cheese was hanging out! Your plea to store owner is good also. DA may not waste his time on such a small amount as well. Find a Lawyer who offers a free consultation.

I didn't completely conceal the item in question, in fact it was more exposed than not. I didn't get the opportunity to even pay for it or the other items. How can they possibly charge me with theft? I feel like the judge or whomever will see the dilemma and hopefully toss the charges. I wrote a letter apologizing for the confusion, and I plan on going in today to apologize and explain that I wasn't stealing. wish me luck!

You repeat that to the point that it's starting to come across more as a contrivance than as a defense - "If I stick this item only part-way into my pocket and they catch me trying to steal it, I can plausibly claim I forgot it was there."

Once again check to see if your state considers concealment a crime! How well you conceal an items means little. By yuor own admission (many times over) you were drunk so you may have not concealed item well due to this (see how drunk defense works againist you) Other items were NOT in your pocket! that says something there. I might add video tape will not work in your favor either it will show you conceal and your actions just before and after concealment may look odd as well! Finally your memory of incident again by your own admission is fuzzy so your own tesimony works againist you. Find an Attorney and get an office visit! Here are things I feel you should do or check on

. State Laws on shoplifting
. Begin couseling and AA for your drinking
. Offer apology to store owner
. Check and see if DA is even going to file on such a small amount

That ranks up there with, "But I didn't inhale".....nobody's going to buy into it.

I'm curious to know how the clerk could see it in your back pocket if you were in the process of placing items on the counter?

Like I said it was blatantly sticking out, everyone could see it. The clerk that saw it was the clerk next to the register I went up to. There were like 15 drunk people in the store at the time, so I think he just freaked out and told the cops outside. I'm meeting with a lawyer next week to figure out the gameplan. I'll keep you posted.
