    When Can You Return to a Store That Banned You
    My question involves criminal law for the state of: New Hampshire

    Ok so here it is I was literally kicked out of a store because this store would open at 8 am, I would go looking for certain items and lots of times the items came in but where on a unattended pallet still boxed. I would aks an employee nicely if they could open the box so I could get what I want, pay and leave. Well they started to have issues with that and saying no even though the item was literally right there in a stack unattended. Well one day I went in and a guy was stocking I said " Can I ask you to open something so I can buy it or will you get all mad" He said " Nope as a matter fact I am going to ask you to leave and not shop here again. If you come back I will call the poilce" . I said "wow ok" and walked out with my 1 year old son. Another manager was following me from far behind I told him nicely not to follow me out like a criminal and to walk next to me. I am wondering can I go back to this store ? They took no photo copy of my id, I signed nothing and all I did was "bug" them about stocking the items I needed while I was there. There is a another Target down the street that literally will let me take the boxes I want off the pallets, open them and get what I need. I never leave a mess, never steal. The store that kicked me out I think was mad because when my son was 3 months old a stocker lifter a giant box, at least 18 inches long , 10 inches high above my son in his stroller instead of going around . I was quite mad and vbrought it up with management . So some help here

    How is it that the product that you want just happens to be on a pallet and not stocked on the shelves each time you go into the store?

    The store that kicked me out I think was mad because when my son was 3 months old a stocker lifter a giant box, at least 18 inches long , 10 inches high above my son in his stroller instead of going around .

    And I think that they were mad because when their employees were busy with their opening duties and trying to get things done, you were interfering and asking for them to interrupt what they were doing because you thought your time was more valuable than theirs and that of the other customers who needed the employees to be up to speed so that they could buy what THEY wanted. It's not all about you and what YOU want.

    She said she usually went in about 8 AM, when the store first opened for the day. That is also normally the time when they would be stocking shelves. That isn't unusual at all.

    Regardless, why are the products always on pallets. With tens of thousands of products in the store the ones she wants are always out of stock? Makes no sense to me.

    Ummm ok did not know I would be met with so many questions.... As the person I quoted said I went it at 8 am when they opened. Sorry if I was in their way trying to buy stuff, They open at 8 am they should be aware of that. The day the fella picked that huge box over my sons stroller I was not asking anybody to do anything I was simply looking at the items on the shelf in front of me, I did not have my stroller blocking the isle or anything I am always trying to stay out of peoples way. And the items I needed happen to be on the pallet everyday cause they just came in. I really though those facts were kind of mute its a retail store I went in when they opened and tried to buy items on the sales floor yes they were still boxed but the intention of them being on the sales floor is to be stocked..... to be.... sold. Why a I getting 20 questions when I go to the Wal-Mart down the street and they are happy to open a box on a pallet and sell stuff to me ? I came on this board for legal questions not to be analyzed about my shopping habits. I have stayed out of the store for like 5 months I want no issues just curious what legal grounds they have.

    The most popular/useful products are the ones that need restocking the most often. It makes perfect sense to me.

    Seriously. EVERY time she goes in, it's always right at opening, and everything she wants is needing to be restocked?

    First off, the legal answer to your question is that if you return to that store, you can be arrested for Criminal Trespass. If you want to shop there, you should phone the manager and ask for the ban to be lifted, and wait until you have a written letter of permission to return.

    That said....

    I work retail.

    For starters, pallets are usually stacked in a certain way, example heaviest items on the bottom, lightest on top, and interlaced then shrink wrapped to prevent boxes from falling off and merchandise damaged.

    These pallets can easily weigh 1500 lbs.

    If I had my old job merchandising beer and wine...I would have to tell you, I'm sorry, but I will have it stocked within the hour (because I work fast), but that 3 liter bottle of Carlo Rossi is on the bottom of a 5 foot tall skid...there is no way to simply take off the upper layers without risk of a lot of breakage, and a lot of cases scattered across the aisle.

    Stores also like their aisles to be as uncrowded as possible. It would not be unreasonable for a store to ask me (outside vendor) to not have a bunch of boxes scattered across the aisle, and my empty boxes stacked neatly in one spot.

    My current position...I have 1-2 boxes, small novelty items. You would not believe how many people have almost tripped over my box because they are too busy on their cell phones to pay attention. My box is shoved right up against my rack.

    Having worked at Kohl's...who knows what is going to get stocked first, because we have a truck to unload. A couple of people to unload the truck, someone to open the boxes, gotta sort onto different carts/racks, get those out to the merchandising team....

    My suggestion would be to shop a little later, when you know the items will have been merchandised. Since the items you want are stocked by Target workers and not vendors, you should be able to figure out approximately what time they are completed with stocking.
