What Are the Odds that a Minor Will be Emancipated
According to the Florida state law, both parents/legal guardians have to initiate the process. The minor must already have a sustainable income, and must show at the court hearing that he or she can support him or herself. Assuming I have a green light for both of these and hold no criminal record, how likely is it that I would be emancipated?
I originally thought that emancipation was only for those who's parents were deceased, and who needed the same abilities as an adult. This concept makes little sense, however, as the parents are the ones who have to start the processes. Unless of course the child's current legal guardians were to sign the documents, but that still leaves the question unanswered as to why the minor would need to be emancipated in the first place.
Anyways, thanks in advance for any information.

We lack the facts to evaluate your theoretical petition.

Did I miss something? I'd be happy to provide any facts that might be of importance. I work 30 hours a week making roughly 18k/year. It's a poverty level income, however, if said emancipation took place the available hours I could work would be unlimited.
Re: What Are the Odds that a Minor Will be Emancipated
If you're not Macauley Culkin or the likes, the court will generally go looking for a reason to deny the petition.
So, from that $18k, you'll need to show that you can pay (after taxes and all of that fun stuff):
Market rent, utilities, clothing, food, transportation (inc. insurance if necessary), health insurance, sundry items. Misc other costs.
Is there a reason why you need to be emancipated?

Sorry, forgot to mention that total is after social security has been taken out. I've looked at apartments for rent in the area and the average utility costs, and after making a very rough budget, I've determined I could afford to live on my own even if I'm still only working the 30 hours a week.
No particular reason. I enjoy working where I do, my parents also work so I only see them every few days due to our conflicting schedule, and quite honestly I feel I should be paying for my own expenses at this point. They don't have great jobs, and from what I gather their financial situation is tight as it always has been. My dad's a hard working guy, I'd like to make life a bit easier for him.
Re: What Are the Odds that a Minor Will be Emancipated
You can rattle off how you meet the qualifications, but you're sharing opinions, not facts, and it will be a judge who makes the call based upon evidence actually presented in court. Even if you meet every criterion set forth in the statute, the court can still find that emancipation is not in your best interest and deny the petition. If you believe you can meet every statutory requirement you are free to have your parents file a petition, and you will subsequently find out if the court agrees that you qualify and if emancipation is in your best interest. It's not our call.
Re: What Are the Odds that a Minor Will be Emancipated
Then you have no need to be emancipated.
It is about need - not wants, afterall.
That aside, let's take a look. You'll be getting 1900/month after taxes. I plugged in Tampa and Bradenton. See what you come up with if you enter your current city vs. whatever.

If you'd like to make life easier for your parents, and can afford to pay rent...pay rent to them. You said they're in a bad financial situation, so I'm sure they'd love the help. Problem solved.
