Ticket for Running Through a Stop Sign
My question involves a traffic ticket from the state of: California. I stopped fully. This stop is at a dangerous area with a blind corner on the right. I asked the Highway Patrol rep. what the definition of a full stop is, and his reply was, "Stop." I told him I stopped and he replied, "My opinion is that you did not stop." I would like to fight the ticket. Can I use his verbage against him? Thank you
Re: I Got a Ticket for Running Through a Stop Sign
When he repeats his testimony that his "opinion is that you did not stop", were you planning on rising, stomping your feet and screaming "Liar, Liar, Pants on Fire!!!" or did you have a better plan?
Re: I Got a Ticket for Running Through a Stop Sign
What was a "stop" to you? Slow, tap the brakes, and go? (i.e. a rolling, or "California" stop?)
If you did not come to a complete stop at the limit line as required by the section, then you failed to comply. If you ask for the officer's definition, that implies to me that you did not actually stop, as in cease all movement, of the vehicle.
22450. (a) The driver of any vehicle approaching a stop sign at the
entrance to, or within, an intersection shall stop at a limit line,
if marked, otherwise before entering the crosswalk on the near side
of the intersection.
If there is no limit line or crosswalk, the driver shall stop at
the entrance to the intersecting roadway.
(b) The driver of a vehicle approaching a stop sign at a railroad
grade crossing shall stop at a limit line, if marked, otherwise
before crossing the first track or entrance to the railroad grade
crossing.
(c) Notwithstanding any other provision of law, a local authority
may adopt rules and regulations by ordinance or resolution providing
for the placement of a stop sign at any location on a highway under
its jurisdiction where the stop sign would enhance traffic safety.

How could you use that verbiage against him? Think about it... He gave you the most simple, clear, unambiguous answer anyone could give....
You, on the other hand, and by asking him what the definition of "stop" means, it is reasonable to assume that you did not know what "stop" means and therefore, if you did not know how it is defined or how a stop is made...
It still ends up being your word against his and you will lose.
Re: Ticket for Running Through a Stop Sign
Thank you everyone for your replies. I don't think I'll try to fight the ticket.
