How to Get Court Approval of an Agreement for Relocation
My question involves a child custody case from the State of: Indiana
My two children and I are recently in the process of relocating out of state. I and the non custodial parent have actually reached terms and came to an agreement for the kids and I to move. I have turned in a 90 day notice of move to the courts stating the new parenting time schedule, all my information of where we are relocating, and phone numbers. I have looked every where and can not find any information on what the process is when an agreement has already been reached with custodial and non custodial parent. And about how long the wait is until I could hear something from the court with approval to move.

A typical process would be to file a motion (or joint motion) to modify the custody order, along with a stipulated order (in proper form) reflecting the amendment, file it with the court and notice it for hearing, serve it on the other party, then appear as required in court. The amount of time it takes to get a court hearing will depend on the court's docket (how busy the court is).

A hearing regarding the relocation itself is not actually necessary if the non-custodial parent has already agreed that you can relocate. I hope you have that in writing from the NCP. However, if you want you parenting schedule to be enforceable, then you should have submitted it to the court as a stipulated agreement.
