Can I Face Charges or Be Arrested for Threatening Text Message
My question involves criminal law for the state of: Colorado
I sent my ex a text, while drunk, stating I wished I could kill her. She is saying she will show it to the police and I will be in trouble. Is this true, and can I face any charges or be arrested for this?
Re: Can I Face Charges or Be Arrested for Threatening Text Message
At the very least, it would be a slam dunk for a restraining order against you (including a firearm restriction). Applicable criminal charges would depend on other facts, such as the exact wording, and how credible or imminent the threat may appear to a reasonable person. Best rule of thumb, if you're going to drink and say stupid things, then take you ex's numbers OUT of your phone.

You should consider alcohol counseling as well, if you are getting drunk and committing crimes that is a pretty good indication that your drinking is out of control.
Also if you do this now it won't hurt if you do end up in court to show that you have been proactive about the issue.
