Father's rights

My husband has a child that is 19. when she was 2 years old her mother filed a petition for child support. the first time my husband went to get her we took her with us, the 2nd time she said she was sick and the 3rd time she told him she was sick and that she might not be his child and not to come back. she never tried to contact us after that, so we did not try to pursue seeing her anymore because of all the problems her mother caused in the past. Now she is 19 almost 20 and we contacted her when she turned 18 and she has been visting us and making her own decision of wanting to know us. now her mother is trying to get child support from us 16 years later. when the child was 6 or 7 her mother had her name changed to the man she was married to. this is the state of illinois. does a child have to be adopted to have their name changed??? she is telling us that she only changed her name now and that she really wasn't adopted. will my husband has to pay back child support on her now???

If the mother of the child never dropped the child support case with the court, your husband is responsible for the back support. Your husband really should have had a DNA when she said that the child was not his.

No, she did not have to be adopted for her name to change her name.

If 17 years have passed, and your husband isn't in jail for being a deadbeat, there's a good chance that the CS case was never completed.
Most times, it is nearly impossible for a mother to get back child support.
I can count on 1 hand, the amount of times I've heard, that back support was issued.
EDIT:
If the child is your husbands ( do that dna test ), and the child is not emancipated, the mother can very well get support from now until emancipation.

If there is/was a court order for support then the money is still owed...if there was a visitation schedule in place and he chose not to see his child that is unfortunate
if there was a support order in place and the child was adopted hubby could still be on the hook for cs up untill the adoption date
