    When Can You Refuse to Provide W-2's for Child Support Calculation
    My question involves child support in the State of: Illinois

    Ex's lawyer keeps requesting my w-2s. I sense that ex wants more money. I am already paying a fair amount and feel that ex is just harassing. Judge has given me 14 days to comply. Ex is a nut job and I don't want her to know where I work. Can I use that as grounds for noncompliance? What will happen if I refuse to comply? Will it keep ex from obtaining a larger CS amount?

    If you refuse to comply with the judge's order than the judge can hold you in contempt of court. You can be fined, jailed and still required to produce those W2s.

    Illinois is a flat percentage of the NCP's income, based on the number of children.

    The judge has given you fourteen days to comply, so if you want to avoid contempt proceedings your best course is to comply. If you refuse to comply, the judge could also potentially choose to impute income to you, significantly above the last salary you documented.

    If you refuse to comply, you're looking at a contempt finding AND the other parent being given what they're asking for.

    You do understand that, yes?

    Illinois takes a straight percentage of the NCPs income. Should we assume that your current income would indeed raise the obligation?

    I'm not sure what would happen if you supplied the W2 with employer name/addy redacted and left the employers tax ID numbers.

    Because that way Mom could still see what he's earning...

    What's to prevent ex from continuing to harass me?

    I make much less than her and find it ridiculous that last time I had to give up 50% of my income just because of day care costs when I know she could easily find a family member to watch the kids for free. No matter what I pay, is she always allowed to harass me about my income?

    I will tell you this: It took two to produce those children. The more you whine about it, the more likely your kids will push you away as they get older. My dad whined about $72 a month. Can you guess why I reluctantly visited him after I was 18, why I was mad at whomever invited him to my High School Graduation and the after pary? Why I did not rush to the hospital when he was on his death bed? Because I was not worth his $72 a month that he whined about.

    Nobody is harassing you. Because Illinois doesn't use the CP's income, it's a straight percentage; if you're earning more or less than when the order was made you can expect a modification hearing.

    You're not in a position to say that Mom can find a relative to provide day-care.

    You shouldn't have even been aware of the child support issue. And even less so before you reached 18.

    My dad had to whine about it during every visit with me. Atleast the visits he didn't cancel.
