Evidence of Fraudulent Use of a Credit Card
My question involves criminal law for the state of: Alabama
My now Ex-husband has been going through a trail for the past 4 or 5 months, involving several counts of frauduant use of a credit card to the tune of over $8000. Recently, in my home, I have found receipts that he kept, accounting for every cent of the money he took from this person. Nobody has contacted me or questioned me (his lawyer or the prosecutor) about his case in any way. (I figured they would at least once, since we were still married and living together at the time he commited the crimes.) So, my question is, do I contact the prosecutor on his case and turn over the receipts? Or just throw them away and keep minding my own business?
Re: I Have Evidence, What Do I Do with It
If he was defrauding someone, perhaps a call to the prosecutors office is in order.

Your home was not searched?
Re: I Have Evidence, What Do I Do with It
No, my home was not searched. I haven't heard from anyone regarding this case since the day he was arrested over 4 months ago. And that was only the investigator, who told me they had security camera pictures of him using the card. I don't know if they thought that the video/pictures were enough, and didn't feel the need to look any further for evidence, or what, but I have all the receipts.

Then send them on to the prosecutor.
Re: I Have Evidence, What Do I Do with It
Let's think about it this way:
If you were defrauded, and someone could produce additional evidence against the person charged...would you want them to pass the receipts to the prosecutor? Or not.
Also...if you throw those receipts out and it is discovered, there is a chance you could face charges, since you're technically destroying potential evidence.
Re: I Have Evidence, What Do I Do with It
You are right, I would want the evidence turned over if I were in that situation. I will give the ADA a call in the morning and see what they have to say. Thanks everyone.

Thank you, and please know you are doing the right thing.
