    Medical Bills for a Child from Before Divorce
    My question involves child support in the State of: Wisconsin

    I will try to write this as easily as I can, to me it is a very complicated situation.

    My husband and his ex wife were divorced in 2009. It states that they have shared 50/50 placement, joint custody, equally share expenses, ect.. pretty normal.

    They are now going back to court due to some placement issues, the ex-wife was found in contempt for not allowing my husband to get his daughter..

    She brought it up at another hearing that there are unpaid medical expenses.. she now gave him copies of bills that are dated 2001-2003 (from their daughters birth, and some follow up appointments years after) They were married while all of these bills were created.

    The medical company took (only) her to court in 2004, and in 2005 she started paying the bills and has now paid $4100(ish) so I do believe they are close to being paid off, if not paid off.

    She is wanting him to pay half of the bills from their daughter in 2001-2003..

    She listed in their divorce agreement that SHE had $6500 in medical bills. She chose to not include/share these bills with him at the time of the divorce..


    -Its not that my husband is absolutely refusing to pay, but were both very unsure of the situation... Do not know how bills that were created 12+years ago can now be brought up 5 years after their divorce.. From what I have found researching, debts that are created while married are both parties responsibilities, until they are paid off. Morally paying her back would be the right thing, yes.. but if she "chose" to pay all the bills herself, and not involve him from the start, or even the middle... isn't that her fault?

    If they divorced in 2009, long after the judgment was issued, I would expect the court to hold that the claim was resolved, implicitly or explicitly, with the entry of the parties property settlement (or judgment). If the ex- has been paying the judgment since 2005, it's obvious that she would have been aware of the judgment at the time of the divorce. I suspect that you don't know all of the facts.

    How would it be that I do not know all, or enough of the facts? The ex wife knew this was a debt while in the process of a divorce and chose to not list it as a equal/shared debt. He listed the few bills he had at the time of the divorce, and so did the ex-wife.. in which this was one of them.
