    Respectfully, I need expert advise in following two situations prior to applying for citizenship. (Sorry for so much detail but wanted to give the clear picture to get proper answer)

    1. Early this year, my wife happened to be stopped by a retail store for taking possession of a merchandise which she happened to keep in purse temporarily due to taking care of our son in restroom (which was a great mistake) and forgetting to pay for that ($9.00) at the cashier checkout. The gentleman asked her to come to the office and asked for driving license and then to sign a paper saying that she should not come to this store until she gets notice from the store headquarter. No police or citation were involved.

    However, we were very upset with the whole thing which was very embarrassing to us, so we went to the store again and talked to that gentlemen (shoplifter picker) and store manager and explained the situation and they understood that it very unintentional and suggested us to talk to loss and prevention dept. I did that and fortunately, a senior officer (over the phone) supported us by saying that it was not considered a shoplifting in first place and now "treaspassing" is lifted out as well so that she can continue shopping in that store but if this kind of incident is repeated in next 6 months then it will trigger treasspassing crime against her after which it will be removed. We only had to pay $50 for picking up a merchandise without being paid. It is now more than 9 months.

    Is it something that we should be worrying about?

    2. I had 2-3 traffic citation one of which I fought by a lawyer (65 over 45) and it was reduced to a waiver. Where should I mention these, if I have to? Also, is it a good idea to request a MVA record and then mention or attach with N-400? Do I have to mention those which is not listed in MVA record?

    As no police were involved in the first incident, there would be no arrest record and no court record and it is nothing to worry about.

    You can expect to have to report your traffic problems, although if they're simple civil infractions (no criminal charges) they shouldn't be a problem. (But stop getting tickets.)

    Sorry for asking again but I wanted to know where in N-400, I should be reporting to and should I take MVA records from MVA office and report all incident from there by attaching that report. Will it be ok?

    I meant to ask that which item from Part 10, I should be selecting as "Yes" for providing the traffic tickets information.

    Excerpt from N-400 form (from Part 10)

    15. Have you ever committed a crime or offense for which you were not arrested?
    16. Have you ever been arrested, cited or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason?
    17. Have you ever been charged with committing any crime or offense?
    18. Have you ever been convicted of a crime or offense?

    My guess would be the item # 16 (with word cited) but I do not want to fill this form with my guess only.

    I really appreciate your responses which certainly helps.
