    Can You Stop Child Support if Your 18 Year Old is Working
    My question involves child support in the State of: Alabama

    Asking this for a friend:

    Long story short, my best friend has an evil, bitter alcohol ex wife thats always taking him back to court for more money any chance she gets. She spends the money on herself and not the kids. He fell behind on child support in 2013 and is still behind (lost his job and house due to economy). Both of his kids are twins and are 18 years old and both work two jobs each. He doesnt feel like he should have to pay it especially since its only going to support his ex.

    So Ii have two questions:

    #1 - Can he have it stopped?

    #2 - Will he have to backpay since he has proof theyve been working and supporting themselves?

    Oh what a delightful person he must be. I'm sure the kids thank him for insulting half of their genetic make up. Must make them feel so wanted.

    So, let's answer the legal part.

    1. He can file to modify, sure.
    2. Mom is absolutely entitled to the back support, and it won't go away unless she agrees to it.

    He should perhaps read something about child support and what it's for.

    Where did he get the idea that child support was intended to be spent on the children?

    Child support is intended to reimburse the CP for the money she has already spent on the children. She is free to use it for anything she likes.

    - Child support also pays for rent, clothing, toilet paper, toothpaste, medical care, dental care...
    - Court order likely says something about Age or High School Graduation or Another Time Period...whichever comes last. Dad needs to read what he agreed to. And remember that it took two to make babies.

    Child support in Alabama goes to age 19, since 19 is the age of majority in that state.

    Child support is also figured on a shared income basis; the state looks at what Mom and Dad both make before consulting their magic chart to figure out what the CS is going to be.

    Thanks for the replies. Yes I see that rent is definitely something to be considered. Thats about all though. I guess I should have explained the situation more so he doesnt sound like a deadbeat dad. He gives them money, bought them both a car, clothes,etc.....All of the time. Of course that is not documented. They stay at his house more than they do at their moms. He loves.his.kids.and.they love him.

    Oh well. He still owes Mom the arrearages and support until the children reach age of majority.

    It's not that he sounds like a deadbeat. It's more that for whatever reason, you seem to believe that your opinion of Mom actually matters.

    Does he even know that you're posting about this "evil, bitter" woman? You know, the one who he chose to be mother of his children?

    Careful how you answer that.
