Because I care about them and I don't want her to have any reason to get them back. No need to be rude. Just because I don't have the info you want doesn't mean he doesn't care.

That says NOTHING that you think it does. It says the kids are with him so the DCS case is closed. That doesn't say he has custody. It doesn't say anything other than the court is terminating the need for dependency court intervention and he owes no money.
So we're right back where we started. Tell dad (if it matters to him at all) to get on the horn, find some court orders and come back when he has them. If he doesn't feel the need to clarify, then there is no reason for you to feel the need to because the onus is on the parent to figure out what's going on, not his girlfriend.

What tells me he doesn't care is the fact that he's not here.
You need to understand that the court doesn't care about you or your feelings. And to be blunt, you have nowhere near enough facts to even loosely discuss things.
So tell him he needs an attorney.

I suspect that what she posted is really all that he has. I suspect that he never took it any further than that and never got custody formalized. I have no idea how it would play out in court since information is so limited, but if that really is all that there is, he doesn't actually have custody legally.

He does have status quo though, and an ex that either didn't know enough, or didn't care enough to fight it.

So you think that after a dependency case has opened up, the other parent shows up and then the court says... OK, good enough. We're done? No identification of said man? No verification that he is who he says he is? Is that how they do things in Indiana? After every hearing would have been minutes that would have been provided to the parties. Something happened before that. Guaranteed.
