    My question involves a condominium located in the State of: Florida
    Hello,
    Recently I purchased a condo where it was made clear to me by the prior owner that washer&dryers inside the unit are not allowed. I haven’t read the association bylaws yet. I received a flyer of a unit for sale in my building from the real estate company listing it and it says that the unit has its own washer&dryer inside. This is a Penthouse unit in the last floor of the building. I called the office to inquired and they told me that those apartments are allow to have washer&dryer inside. Is this legal? Or can I make my case of discrimination? Why some units are allow to have it and others don’t?

    Yes, it is legal. You do not have a right under the law to have a washer and dryer in your condo. Therefore, there is no case for illegal discrimination.

    There is nothing illegal about having different perks for different units.

    You are confusing discrimination and illegal discrimination. Most discrimination is perfectly legal. Only discrimination against protected classes is illegal. Obviously washer and dryer is not a protected class.

    As to why you are not allowed and someone else is: that would depend on history of your complex. You can probably go to a board meeting and ask the board directly. For example, where I'm at, 1st floor units are allowed to have washer/dryers because they have stairs inside and a large family room in basement where the washer and dryer are. The remaining upper floor units are not allowed to have one because of the laundry contract with the laundry company which does not allow for units covered in the contract to have their own. If you have a similar contract and the condo association were to allow this and the laundry company finds out, a lawsuit can ensue and you will be asked to remove regardless of your wishes or those of the COA.
